The Ho Chi Minh City Department of Agriculture and Environment is seeking opinions on the draft new regulations of the Ho Chi Minh City People's Committee on compensation, support, and resettlement when the State recovers land in the city.
One of the notable contents is the proposal for bonus levels for cases of complying with site handover before the deadline as prescribed, implementing Clause 7, Article 111 of the Land Law.
According to the draft, for cases where the entire land area is recovered:
Organizations (excluding state agencies and administrative and non-business units) that hand over land before the deadline will be rewarded 100 million VND/organization.
Households and individuals who hand over land before the deadline are rewarded 50 million VND/household.
Cases where only a part of the land area belonging to the project is recovered:
The organization is rewarded 50% of the bonus level of the case of full recovery, equivalent to 50 million VND.
Households and individuals are rewarded 25 million VND, equal to 50% of the prescribed bonus level.
For cases where organizations, households or individuals are recovered many types of land at the same location in a project, they will be considered for support according to the highest level in the above bonus levels. If there are many houses and land cleared at different locations, compensation and support will be resolved according to each specific dossier.
Supporting more residential land and apartments for large and multi-generational households
In addition to the bonus policy, the draft also proposes regulations to support the allocation of residential land for households with many generations or many couples living together on a recovered land plot, according to Clause 10, Article 111 of the Land Law.
If the compensated residential land area is not enough to be allocated separately to each household according to residence regulations, the remaining households will be considered for support as follows:
Cases where the project has a resettlement apartment fund: Each household is allowed to sell, lease or lease-purchase an apartment in the resettlement housing fund of the project.
In case the project only arranges resettlement with land plots: Each household is allocated a land plot with land use fee collection, according to the resettlement price approved in the compensation, support, and resettlement plan.
The consideration of support only applies when all conditions are met, including: The area of residential land to be recovered is greater than 160m2 and households with 7 or more people.
