Ho Chi Minh City plans to recognize 13 types of land papers before October 15, 1993 to issue red books

Ho Chi Minh City is expected to recognize 13 other types of land use right documents dated before October 15, 1993 to issue red books to households and individuals who are using land stably.

The Ho Chi Minh City Department of Agriculture and Environment is seeking opinions on the draft Decision of the Ho Chi Minh City People's Committee regulating other types of land use right documents dated before October 15, 1993 in the city.

It is expected that 13 other types of land use right documents dated before October 15, 1993 in Ho Chi Minh City will be used as a basis for considering issuing Certificates of land use rights and ownership of assets attached to land to households and individuals who are using land stably without having to pay land use fees.

1. The inventory book is made during the process of land registration according to Directive No. 299/TTg dated November 10, 1980 of the Prime Minister on surveying, classifying and registering land in the whole country, managed by state agencies and with the name of land users.

2. Housing authorization and ownership authorization permits issued by the Department of Housing and Land Management and Public Works, the Department of Housing or the People's Committee of districts, with content recognizing the right to own houses and residential land use rights for the authorized person.

3. Installment housing purchase and sale contract performed by a functional agency (built for sale), accompanied by a record of liquidation of the house purchase and sale contract and a certificate of completion of installment housing purchase payment.

4. Documents for transferring land use rights, buying and selling houses certified by the commune-level People's Committee with the signature of the buyer or seller or certified for the purchase and sale.

5. Decisions on land allocation to households and individuals for use are issued by the Provincial or District People's Committees at the time of land allocation.

6. Documents transferring labor achievements and investment results associated with land use rights certified by the District-level People's Committee or provincial-level land management agency.

7. Application for land use that has been confirmed or approved by the provincial-level land management agency.

8. Documents of competent state agencies on land allocation and land use permits for households and individuals.

9. Land and house certificates issued by commune-level, district-level or provincial-level People's Committees to households and individuals.

10. Application for a Certificate of Land Use Rights and actual measurement minutes certified by the commune-level People's Committee.

11. Certificate of land use rights (white) issued by the District People's Committee to households and individuals.

12. Cadastral maps, cadastral maps through periods with names of land users and lists of people granted Certificates certified by competent authorities.

13. Documents agreeing on inheritance division, transfer contracts, donation contracts for land or housing certified by the commune or district-level People's Committee.

The subjects of application are agencies performing state management functions on land; state agencies related to the settlement of dossiers for registration and issuance of Certificates of land use rights and other assets attached to land. Households and individuals who are using land stably according to the provisions of point n, clause 1, Article 137 of the Land Law No. 31/2024/QH15.

It is expected that the decision will be considered and approved by the Ho Chi Minh City People's Committee and promulgated in the third quarter of 2026.
