The order and procedures for developing the first land price list to be announced and applied from January 1, 2026 and adjusting, amending, and supplementing the annual land price list to be announced and applied from January 1 of the following year are as follows:
Step 1. The competent land management agency shall establish a project to build a land price list, in which the content, time, progress, implementation cost estimate and related contents are determined.
Step 2. The competent land management agency prepares the project appraisal dossier to build a land price list and sends it to the Department of Finance; the Department of Finance is responsible for appraising and sending the document appraising the project to build a land price list to the competent land management agency. The project appraisal dossier for building a land price list includes:
- Official dispatch requesting appraisal of the project to build a land price list;
- Draft Project to build land price lists;
- Draft Submission on project approval;
- Draft Decision of the Provincial People's Committee on approving the project.
Step 3. The competent land management agency shall receive, complete the appraisal opinions and submit to the Provincial People's Committee the project dossier to build a land price list.
The project dossier for building a land price list includes:
- The project to build a land price list after receiving and completing the appraisal opinion;
- Report on project approval;
- Draft Decision of the Provincial People's Committee on approving the project;
- Documents for appraisal of project documents to build land price lists.
Step 4. The Provincial People's Committee directs departments, branches, Commune People's Committees, Management Boards of high-tech parks and economic zones (if any) to develop land price lists.
Step 5. The competent land management agency shall select an organization to conduct land valuation to build a land price list or place an order, and assign tasks to a public service unit qualified to act as a consultant for land price determination.
Step 6. The Department of Finance shall submit to the Chairman of the Provincial People's Committee a member of the Land Price List Appraisal Council as prescribed in Clause 1, Article 161 of the Land Law for appraisal of the draft land price list.
Step 7. The Department of Finance submits to the Chairman of the Land Price List Appraisal Council the decision to establish a Council Working Group.
Step 8. Organize land valuation to build land price lists:
- Investigate, survey, and collect information to serve the construction of land price lists by area and location; the construction of land price lists to each plot of land on the basis of value areas and standard land plots;
- Determine the type of land, area, and land location in each commune, ward, and town for the area for building a land price list by area and location; determine the type of land, total number of plots of land, and number of plots of land for each type of land for the area for building a land price list to each plot of land on the basis of the value area and standard plots of land;
- Synthesize and complete the results of surveys, surveys, and information collection at the commune and provincial levels; analyze and evaluate the results of the implementation of the current land price list for the construction of land price lists by area and location;
- Synthesize the results of investigation, survey, information collection; establish value areas; select standard land plots and determine prices for standard land plots; establish a comparison ratio table for the construction of a land price list for each plot of land based on the value area and standard land plot;
- Develop a draft land price list and a draft Explanatory Report on the development of a land price list.
Step 9. The competent land management agency shall:
- Draft a Report on the issuance of a land price list;
- Post a dossier to collect opinions on the draft land price list on the information page
electronic records of the Provincial People's Committee or agency with the function of land management within 30 days;
- Receive written opinions on the draft land price list. Documents for collecting comments on the draft land price list:
+ Draft Submission on the issuance of land price lists;
+ Draft land price list;
+ Draft Report explaining the construction of land price lists.
- Receive and complete the draft Submission on the issuance of land price lists;
- Direct the reception and explanation of comments, completion of draft land price lists and Explanatory Report on the construction of land price lists.
Step 10. The competent land management agency shall submit to the Land Price List Appraisal Council. The dossier for submitting for appraisal of the land price list includes:
- Proposal on the issuance of land price lists;
- Draft land price list;
- Explanatory report on the construction of land price lists;
- Report on receiving and explaining comments on the draft land price list. ;
Step 11. The Land Price List Appraisal Council conducts the appraisal of the land price list and sends the land price list appraisal document to the competent land management agency.
Step 12. Agencies with land management functions:
- Organize the implementation of receiving, explaining, editing and completing the draft land price list according to the opinion of the Land Price List Appraisal Council.
- Submit to the People's Committee at the provincial level to decide on the land price list. The dossier includes:
+ Proposal on the issuance of land price lists;
+ Draft land price list;
+ Explanatory report on building a land price list;
+ Report on receiving and explaining comments on the draft land price list;
+ Document on land price list appraisal;
+ Report on receipt and explanation of opinions on land price list appraisal.
Step 13. The provincial People's Committee decides on the land price list.
Step 14. The provincial People's Committee publicly announces and directs updates to the national land database.
Step 15. Within 15 days from the date of the decision to build, adjust, amend and supplement the land price list, the People's Committee at the provincial level shall send the results of issuing the land price list to the Ministry of Agriculture and Environment according to Form No. 28 issued with this Decree.
Step 16. In case it is necessary to adjust, amend and supplement the land price list during the year, the Provincial People's Committee shall decide to apply one or more steps in the order prescribed in this Section.
The competent land management agency at the provincial level shall submit to the People's Committee of the same level a decision to adjust, amend and supplement the land price list.
In addition to the methods of determining land prices to build a land price list according to regulations, based on the actual situation in the locality, land prices in the land price list of the area, location with similar infrastructure conditions to determine land prices to adjust, amend, and supplement the land price list.
In the process of deciding to adjust, amend, or supplement the land price list, if necessary, the agency with the function of provincial land management may hire a consulting organization to determine land prices or place an order, assign tasks to a public service unit qualified to conduct consulting activities to determine land prices for adjustment, amendment, or supplementation.
