1. What is land allocation without land use fees?
According to Clause 34, Article 3 of the 2024 Land Law, the State allocates land use rights (hereinafter referred to as the State allocates land) is the competent state agency issuing a decision to allocate land to a subject in need of land use.
Land use rights are allocated by the State in two forms: Allocation of land use rights without land use fees and allocation of land use rights with land use fees.
In particular, land allocation without land use fees is a case of land allocation in which the land user does not have to pay land use fees to the State when falling under one of the cases prescribed by law or the land user is exempted from land use fees.
2. In which cases is land allocated without land use fees collected?
According to Article 118 of the 2024 Land Law, land users are allocated residential land without collecting land use fees in the following cases:
- Individuals directly engaged in agricultural production are allocated agricultural land within the prescribed limits.
- Land to build the headquarters of the Communist Party of Vietnam, State agencies, Vietnam Fatherland Front, socio -political organizations; Social -professional political and professional organizations, social -professional organizations, social organizations and other organizations shall be established according to the provisions of law and are assigned by the State, supporting regular operating funds; national defense and security; land used for public purposes is not for business purposes; Cemetery land, funeral houses, cremation facilities, and facilities to store ashes are not in the case specified in Clause 2, Article 119 of the Land Law 2024; Belief land for compensation for the case of the State recovers beliefs.
- People using special-use forest land, protective forest land, and production forest land.
- Public service units using land to build public works.
- Communities using agricultural land; religious organizations, affiliated religious organizations using land.
- Agencies and organizations using land to implement investment projects to build public housing.
- Ethnic minorities who are not individuals directly engaged in agricultural production but are subject to land allocation without land use fees.
- Organize land use to build housing for resettlement under State projects.
- The land allocation prescribed in this Article is implemented in accordance with the provisions of Article 124 of the 2024 Land Law.
