Talking to Lao Dong Newspaper, lawyer Nguyen Ngoc Tu - Law Firm LawKey Co., Ltd. said that based on Clause 2, Article 43 of the 2025 Construction Law, which generally stipulates the issuance of construction permits, houses under 6 floors in urban areas will not have to apply for a construction permit if:
- Houses with a total floor area of less than 500 m2;
- Houses that are not located in areas requiring planning and architectural management, such as urban areas, functional areas, economic zones, tourist areas, areas that have general plans or have issued architectural management regulations.
For building houses under 6 floors that are not eligible for exemption from construction permits, people must carry out procedures to apply for a construction permit before starting construction. According to Article 60 of Decree 217/2026/ND-CP, the dossier requesting a construction permit includes:
- Application for a construction permit;
- Legal papers on land;
- Construction design documents as prescribed;
- Other documents depending on the nature and scale of the project according to the provisions of law.
After preparing complete dossiers, people submit them to competent authorities for consideration and issuance of construction permits according to regulations.
