The 2025 Construction Law (effective from July 1, 2026) stipulates many new points on construction works. In which, Article 46 of the 2025 Construction Law details the rights and responsibilities of organizations and individuals requesting construction permits. Specifically:
Article 46. Rights and responsibilities of organizations and individuals requesting construction permits
1. Organizations and individuals requesting a construction permit have the following rights:
a) Request the competent authority issuing the construction permit to explain, guide and properly implement the regulations on issuing construction permits;
b) Complaints, lawsuits, denunciations of organizations and individuals with acts of violating the law in the issuance of construction permits;
c) Commence construction of works according to the provisions of this Law.
2. Organizations and individuals requesting construction permits are responsible for the following:
a) Submit complete dossiers and be responsible for the accuracy and truthfulness of the content of the application for a construction permit;
b) Ensure the validity of land use rights and ownership of works on land for the content of the construction permit application;
c) Pay construction permit fees as prescribed;
d) Notice of commencement of construction as prescribed in point d, clause 1, Article 48 of this Law;
e) Implement the correct contents of the construction permit.
