The 2025 Construction Law (effective from July 1, 2026) stipulates many new points on construction works. Based on Article 48 of the 2025 Construction Law stipulating conditions for starting construction works. Specifically:
Article 48. Conditions for starting construction of works
1. The commencement of construction of works, except for cases specified in Clauses 2 and 3 of this Article, must ensure the following conditions:
a) Having a construction site for complete or partial handover;
b) Having a construction permit as prescribed in Article 43 of this Law;
c) Having the construction drawing design of the project part, project item, and commencement project that has been approved;
d) The investor has concluded a construction contract with the contractor to carry out construction activities related to the project started according to the construction progress;
e) The investor has sent a construction commencement notice in writing or online (except for individual houses of households and individuals) to the state management agency for construction in the locality.
2. The commencement of construction of the following works only needs to meet the conditions specified in point a, clause 1 of this Article:
a) Emergency, urgent works and works under special public investment projects;
b) The project needs to start soon according to the direction of competent authorities decided by the Prime Minister.
3. The commencement of construction of individual houses of households and individuals only needs to meet the conditions specified in point b, clause 1 of this Article and is built on legal residential land according to the provisions of land law.
