Pursuant to Clause 4, Article 36 of Decree 95/2024/ND-CP:
Article 36. Orders to buy commercial housing to build housing for resettlement
4. The price of commercial housing for sale in the contract for placement and resettlement is determined based on the market price reference at the time of placement, including house construction investment costs, land use fees, apartment maintenance costs if it is the purchase of an apartment building, and other reasonable costs according to regulations;
In case the host agency and the coordinating agency cannot agree on the home purchase price plan, they can hire a price appraisal enterprise to consult on determining the value of assets as one of the facilities for considering and deciding on the commercial housing purchase and sale price specified in this clause; the cost of hiring a price appraisal enterprise is included in the cost of purchasing commercial housing.
The selling price of houses for resettled people in the sale and purchase contract signed between the investor of a commercial housing project and the resettled person is determined by the purchase and sale price according to the ordering contract; in case the resettlement compensation is lower than the purchase price of this resettlement house, the resettled person must pay the remaining difference to the unit assigned to arrange resettlement housing.
According to the above regulations, in case the resettlement compensation is lower than the purchase price of this resettlement house, the person to be resettled must pay the remaining difference to the unit assigned to arrange the resettlement house.
