Maternity allowance suspended because Ames Company owes social insurance

Child is over 16 months old, mother has not received maternity benefits

After many reflections to Ames Company, social insurance agency... but the maternity allowance was still not received, Ms. Pham Phuong May (Hanoi) wrote a petition requesting support to Lao Dong Newspaper.

With a tired, tense look, Ms. May said: "I used to work at Ames Company from January 2021 - May 2025. From November 2024 to May 2025, I took maternity leave according to regulations. By May 2025, due to circumstances, especially through the VssID application, I noticed signs of "abnormality" in the Company's implementation of social insurance payment for employees, although the monthly salary of employees was deducted by the Company to pay social insurance - so I submitted a resignation application and received confirmation of agreement from the branch director. Immediately after that, the leader texted me requesting to hand over and transfer the position of group leader (Admin) in all working groups with customers to the branch director. I fully fulfilled the responsibility of handing over work before maternity leave and maintaining the company's reputation with customers until the last minute, but the company did not guarantee enough benefits for me.

According to Ms. May, her life is falling into a dead end. "Currently, I am having to manage to take care of my young child alone, without a source of income because I cannot go back to work. All financial burdens from diapers, medicine for the child to the minimum living expenses of the whole family fall on my husband's shoulders. With the meager salary of a worker raising three mouths to feed in this expensive time, my family is always in a state of shortage. In particular, the maternity allowance that should have been a lifebuoy to help the family cover the hard months of confinement, I now do not receive at all. This financial shortage not only makes my child (now over 16 months old - PV) disadvantaged in terms of care conditions but also pushes me into a state of prolonged psychological crisis and anxiety because I feel my rights are seriously violated" - Ms. May said indignantly.

In addition to not receiving maternity benefits, Ms. May also does not receive unemployment benefits - this is a very big disadvantage for workers. To claim her legitimate rights, Ms. May has repeatedly sent petitions to the company's leaders, the Department of Home Affairs, Cau Giay Social Insurance... but the case still goes into a "dead end"!

The reason is that the Company owes social insurance!

According to the investigation of Lao Dong Newspaper reporters, on July 17, 2025, Cau Giay Social Insurance had information: As of the end of June 2025, Ames Company still owes social insurance, health insurance, and compulsory unemployment insurance contributions with an amount of more than 6.7 billion VND - equivalent to 20 months of debt.

Also according to Cau Giay Social Insurance, in 2023, Hanoi Social Insurance implemented inspections and examinations of social insurance, health insurance, unemployment insurance, and occupational accident and disease insurance contributions at Ames Company. After inspection, Ames Company has transferred a portion of social insurance, health insurance, unemployment insurance, and occupational accident and disease insurance contributions to employees every month. However, by July 2025, the company had not yet completed its social insurance contribution obligations... thereby affecting the settlement of benefits for employees.

Cau Giay Social Insurance has approved the request to pay maternity benefits to Ms. Pham Phuong May (social insurance code: 013069xxxx) with the amount of 36,680,000 VND. However, at the time of approval, Ames Company still owed social insurance contributions... to employees, so the social insurance agency has not transferred money to pay maternity benefits of Ms. Pham Phuong May.

On April 7, Ms. Duong Thi Minh Chau - Head of the Propaganda and Support Department for Social Insurance Participants of Hanoi City - said that as of the end of February 2026, Ames Company still owed more than 6.298 billion VND in social insurance, health insurance, and unemployment insurance contributions, with a period of 21 months; ranked 38th in the list of enterprises with the highest social insurance payment delays in Hanoi City; affecting the rights of more than 100 employees.

Statistics show that Hanoi City currently has over 19,670 units that are late in paying social insurance with a total amount of up to hundreds of billions of VND. Notably, many businesses have large debts, lasting for many months, even years, that have not been completely resolved. This situation not only reflects difficulties in production and business activities but also shows that the awareness of law compliance of a part of businesses is still limited.

Failure to register for social insurance participation or late payment of social insurance not only directly affects the legitimate rights of employees but is also a violation of the law. Depending on the severity and nature of the violation, units may be administratively sanctioned, even considered for criminal handling according to current regulations" - Mr. Vu Duc Thuat - Deputy Director of Hanoi Social Insurance - emphasized.
