In the 2012 Trade Union Law (currently in effect), the State's responsibility towards the Trade Union is stipulated in Article 21. Accordingly, the State is responsible for: Ensuring, supporting, and creating conditions for the Trade Union to perform its functions, rights, and responsibilities according to the provisions of law; propagating, disseminating, and educating on labor, trade unions, and other legal provisions related to the Trade Union organization, the rights and obligations of workers; inspecting, examining, supervising, and handling violations of trade union laws; coordinating with the Trade Union to care for and ensure the legitimate and legal rights and interests of workers.
The State is also responsible for consulting the Trade Union when developing policies and laws directly related to the Trade Union organization, rights and obligations of workers; coordinating and creating conditions for trade unions to participate in State management, socio-economic management, representing and protecting the legitimate and legal rights and interests of workers.
Meanwhile, in the 2024 Trade Union Law, the State's responsibility towards the Trade Union is stipulated in Article 23. Mr. Le Dinh Quang - Deputy Head of the Department of Legal Policy and Labor Relations (Vietnam General Confederation of Labor) analyzed that compared to the 2012 Trade Union Law, the 2024 Trade Union Law has added the responsibility of the State to have a policy of prioritizing the recruitment of full-time trade union officials who have grown up from the grassroots, and workers who have grown up in the workers' movement and trade union activities.
In addition, the State promptly handles the recommendations of the Trade Union related to caring for and protecting the legitimate and legal rights and interests of workers and trade union activities.
The 2024 Trade Union Law also adds the responsibility of the Government, ministries, ministerial-level agencies, and local authorities in providing necessary information and documents for trade unions to participate in giving opinions and social criticism according to regulations.
