Youme Law Firm LLC said that according to Article 9 of Decree 178/2024/ND-CP amended by Clause 9, Article 1 of Decree 67/2025/ND-CP, which stipulates the policy on resignation for cadres, civil servants and employees working at associations specified in Point a, Point b, Point g, Clause 1 and Clause 3, Article 2 of Decree 178/2024/ND-CP amended by Clause 2, Article 1 of Decree 67/2025/ND-CP, specifically:
Cadres and civil servants who are 2 years or more old and have reached the retirement age specified in Appendix 1 and Appendix 2 issued with Decree 135/2020/ND-CP and are not eligible for the early retirement policy specified in Article 7, Article 7a, Article 7b of Decree 178/2024/ND-CP, if they quit their jobs, will enjoy the following benefits:
- Receive severance pay:
+ For those who quit their jobs within the first 12 months from the date of the decision to reorganize the apparatus by the competent authority, they will receive a subsidy equal to 0.8 months of current salary multiplied by the number of months for which the severance allowance is calculated.
+ For those who quit their jobs from the 13th month onwards from the date of the decision to reorganize the apparatus by the competent authority, they will receive 0.4 months of current salary multiplied by the number of months for which the severance allowance is calculated.
- Receive a subsidy of 1.5 months of current salary for each year of work with compulsory social insurance contributions.
- Receive social insurance payment period reserved or receive one-time social insurance according to the provisions of the law on social insurance.
- Receive a subsidy of 3 months of current salary to find a job.
Thus, civil servants who quit their jobs within the first 12 months from the date of the decision to reorganize the apparatus by the competent authority will receive a subsidy equal to 0.8 months of current salary multiplied by the number of months for which the severance allowance is calculated.
