According to Article 4 of Decree 115/2020/ND-CP (amended by Clause 1, Article 1 of Decree 85/2023/ND-CP), it is stipulated that:
Basis for recruiting civil servants
1. Recruitment of civil servants must be based on job requirements, job positions, professional title standards and salary funds of public service units.
2. The head of a public service unit specified in Clause 1, Article 7 of this Decree or the competent authority managing a public service unit specified in Clause 2, Article 7 of this Decree or the head of a decentralized or authorized agency or unit shall develop a recruitment plan, decide within its authority or report to the civil servant management agency for approval as a basis for recruitment before each recruitment period. The recruitment plan shall include:
a) Number of assigned employees and number of unused employees of public service units;
b) Number of people needed for each job position, including determining the job positions that candidates can register for 2 wishes. The job positions that candidates can register for 2 wishes must have the same standards and conditions, the same Examination Council, apply the written exam format (round 2) and the same exam questions;
c) Number of job positions to be recruited for ethnic minorities (if any), clearly identifying the quota and ethnic structure to be recruited;
d) Standards and conditions for applying for each job position;
d) Form and content of entrance examination or selection;
e) Other contents (if any).
Public service units specified in Clause 1, Article 7 of this Decree shall develop and decide on recruitment plans according to the provisions of this Clause without having to report to the competent authority managing the public service unit for approval.
According to Clause 1, Article 9 of the Law on Civil Servants 2010, a public service unit is an organization established by a competent State agency, political organization, or socio-political organization in accordance with the provisions of law, has legal status, provides public services, and serves state management.
