1. Implementation procedures
Step 1:
- Within 20 days before the employee is eligible for pension, the employer shall submit the application to the social insurance agency.
- In case the person holding back the compulsory social insurance payment period: Within 20 days before the pension eligibility period, the person holding back the compulsory social insurance payment period must submit the application to the social insurance agency.
Step 2:
- Within 20 days, excluding holidays and Tet, from the date of receiving a complete dossier according to regulations for pensioners, the social insurance agency is responsible for handling the pension.
- In case of not being resolved, a written response must be given with a clear reason.
2. Record
2.1. For those participating in compulsory social insurance
- Social insurance book.
- Original or copy of the document determining the termination of the labor contract or the termination document or the request of the subject:
+ Workers working abroad under contracts.
+ Husband or wife working abroad at a diplomatic representative agency.
+ Business owners of business households with business registration pay taxes according to the declaration method.
+ Business manager, member of the Board of Directors, Control Board, and cooperative management position not receiving salary.
2.2 For those who are reserving the time for compulsory social insurance payment
- Social insurance book.
- Proposal document of the person who is reserving the compulsory social insurance payment period.
2.3. For workers with reduced working capacity
- Social insurance book.
- Original or copy of the document determining the termination of the labor contract or the termination document or the request of the subject:
+ Workers working abroad under contracts.
+ Husband or wife working abroad at a diplomatic representative agency.
+ Business owners of business households with business registration pay taxes according to the declaration method.
+ Business manager, member of the Board of Directors, Control Board, and cooperative management position not receiving salary.
- Minutes of assessment of the level of reduced working capacity of the Medical Assessment Council or a copy of the certificate of severe or extremely severe disability can show the conclusion of the Medical Assessment Council clearly stating the percentage of reduced working capacity.
2.4. For people infected with HIV/AIDS due to occupational accidents while performing assigned tasks
- Social insurance book
- Original or copy of the document determining the termination of the labor contract or the termination document or the request of the subject:
+ Workers working abroad under contracts.
+ Husband or wife working abroad at a diplomatic representative agency.
+ Business owners of business households with business registration pay taxes according to the declaration method.
+ Business manager, member of the Board of Directors, Control Board, and cooperative management position not receiving salary.
- Certificate of HIV infection due to occupational accidents.
3. Scope of settlement
Within 20 days, excluding holidays and Tet, from the date of receiving a complete dossier as prescribed.
4. Subjects performing administrative procedures
- Employees participating in compulsory social insurance.
- Employees who are reserving the time for compulsory social insurance payment.
- Employees who have paid social insurance for 15 years or more and have a document from the social insurance agency confirming their waiting for age eligibility to receive pension as prescribed in Decree No. 12/CP dated January 26, 1995 amended and supplemented a number of articles according to Decree No. 01/2003/ND-CP dated January 9, 2003 of the Government.
- Commune officials subject to the regulation of Decree No. 09/1998/ND-CP who have a decision or certificate of waiting for age eligibility to receive monthly allowances from the social insurance agency.
- Employer.
