Clause 4, Clause 5, Article 2 of Decree 154/2025/ND-CP stipulates that non-professional workers at the commune level will retire immediately from the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government 2025 and non-professional workers in villages and residential groups that are redundant due to the arrangement of villages and residential groups will retire immediately from the date of the arrangement decision of the competent authority subject to the staff reduction policy.
Accordingly, non-professional cadres at the commune level and in villages and residential groups who are subjects specified in Articles 9 and 10 of Decree 154/2025/ND-CP are entitled to the staff streamlining policy.
In Official Dispatch 12/CV-BCD in 2025, the Steering Committee for the implementation of the arrangement and reorganization of administrative units at all levels and the development of a model for organizing local government at both levels has the following instructions:
4. In case the local Party Committee and government at the commune level has a need to use and the non-professional workers at the old commune level wish to continue working, the local Party Committee and government will consider and temporarily arrange them to the position of work support for the operation of the political system of the new commune-level administrative unit (party agency, Fatherland Front and socio-political organizations, local government) or participate in the positions of non-professional workers in the village or residential group before May 31, 2026 and continue to receive allowances, regimes and policies issued by the Provincial People's Council. During this time, if part-time workers at the commune level quit their jobs, they will enjoy the regime and policies according to the provisions of Decree No. 154/2025/ND-CP.
At the same time, Clause 6, Article 33 of Decree 33/2023/ND-CP stipulates that part-time workers in villages and residential groups with no more than 3 positions (including Party Cell Secretary, Village Head or Residential Group Head, Head of the Front Working Committee) are entitled to monthly allowances.
Thus, according to the above contents, non-professional cadres at the commune level who continue to work in the positions of Party Cell Secretary, Village Head or Head of Residential Group will receive allowances, regimes and policies issued by the Provincial People's Council.
In case of retirement before May 31, 2026, they will enjoy the regime and policies according to the provisions of Decree 154/2025/ND-CP.
