In Official Dispatch 7707/BNV-TCBC dated September 10, 2025 sent to the Department of Home Affairs of Bac Ninh province, the Ministry of Home Affairs has provided guidance on resolving some difficulties and problems in implementing Decree 154/2025/ND-CP on staff streamlining.
Regarding the signing of labor contracts after enjoying the regime and policies according to Decree 154/2025/ND-CP, the Ministry of Home Affairs stated:
Clause 6, Article 3 of Decree 154/2025/ND-CP stipulates:
"If the subject of staff reduction is elected or re-recruited to agencies, organizations, and units receiving salaries from the state budget or arranged as a part-time worker in villages and residential groups within 60 months from the date of staff reduction, the subsidy received must be refunded to the agency, organization, or unit that paid the subsidy".
Accordingly, in the case of non-professional workers at the commune level who have enjoyed policies and regimes according to Decree 154/2025/ND-CP, signed labor contracts at other job positions (such as clerical, driver, shift worker) and do not have to return the allowance received to the agency, organization, or unit that has paid the allowance according to the provisions of Clause 6, Article 3 of Decree 154/2025/ND-CP.
Thus, part-time workers at the commune level who have enjoyed policies and regimes according to Decree 154/2025/ND-CP, are allowed to sign labor contracts at other job positions (such as clerical, driver, shift staff) and do not have to return the allowance received to the agency, organization, or unit that has paid the allowance according to the provisions of Clause 6, Article 3 of Decree 154/2025/ND-CP.
