According to Article 2 of Resolution No. 24/2023/NQ-HDND of the People's Council of Ca Mau province, supplemented by Clause 2, Article 1 of Resolution 10/2024/NQ-HDND effective from November 1, 2024, the subjects entitled to the policy of encouraging early retirement include: Elected officials holding positions and titles according to their terms in agencies of the Party, government, and socio-political organizations; civil servants and public employees holding leadership and management positions; civil servants and public employees not holding leadership and management positions; commune-level civil servants and a number of other subjects as prescribed.
Beneficiaries of the policy of encouraging early retirement must satisfy the following conditions:
Article 3. Conditions for enjoying policies
1. Have remaining working time from more than 6 months (from the date of termination decision by competent authority) to full 36 months, calculated from the retirement time according to regulations.
In case at the time of termination of employment, the employee has not worked for a full month, if the total number of working days and paid leave days (holidays, New Year, annual leave, paid personal leave according to the provisions of the Labor Code) accounts for 50% of the number of normal working days in the month, then that month is considered 1 working month.
2. Officers resign at their own will, with the approval of competent authorities.
Commune-level cadres who satisfy the above conditions when leaving work, in addition to receiving severance allowance according to current regulations, will be supported with an additional 1/2 month of current salary for each month of leaving work before retirement age.
Current monthly salary that is eligible for support includes: Salary according to rank, position, title, professional title, leadership position allowance, seniority allowance beyond the framework, seniority allowance, public service allowance, allowance for party work, political and social organizations and salary retention differential coefficient (according to regulations).
The subjects supported by this policy, if recruited or re-elected to public agencies and units of the Party, government, Fatherland Front and socio-political organizations, associations assigned to the provincial, district and commune levels, must fully repay the support amount received. The agencies and units that re-recruit or elect people who have received support under this regulation are responsible for recovering the support amount and paying it into the state budget.
