Clause 1, Article 5 of Decree No. 147/2025/ND-CP stipulates the authority to decide on receiving, adjusting the level of receiving, ceasing to receive monthly social allowances, and supporting monthly care and support costs for social protection beneficiaries as follows:
The authority to decide to receive and adjust the monthly social allowance and support monthly care and nurturing costs for social protection beneficiaries is stipulated in Decree No. 20/2021/ND-CP dated March 15, 2021 of the Government regulating social assistance policies implemented by the Chairman of the People's Committee at the commune level.
Point d, Clause 2, Article 5 stipulates the case of adjusting the social allowance level as follows:
In case the subject receiving social allowances and monthly care and support support funds dies, is no longer eligible for benefits or changes the conditions for benefits, the Chairman of the People's Committee at the commune level shall consider and decide to stop receiving benefits or adjust the benefit level. The time of ceasing to receive or adjusting the benefit level is from the month immediately after the month the subject died, was not eligible for the benefit or changed the benefit condition;
Decree No. 147/2025/ND-CP stipulates the division of authority of local governments according to the model of organizing two-level local governments in the field of state management of the Ministry of Health. The Decree takes effect from July 1, 2025 to March 1, 2027.
