Trade union supports workers to sue businesses owing social insurance

Two years accompanying employees in pursuing the social insurance debt lawsuit

In August 2019, Ms. Le Thi Viem (54 years old, from An Giang) started working at the Branch of Sang Production - Import-Export - Trading Co., Ltd. (in Thuan An ward, Ho Chi Minh City), and resigned in February 2024. However, Ms. Viem was not fully paid social insurance by the company and the book was finalized and returned.

Although I have come to the company many times, I have not met the leaders and it has not been resolved. Social insurance debt makes it difficult for me to find a new job, and when I am sick, I am not covered by insurance. Not understanding legal procedures, I went to the Binh Duong Trade Union Legal Consulting Center and was supported and accompanied by Mr. Nguyen Van Dung - Deputy Director of the Center - to protect my rights" - Ms. Viem shared.

According to Ms. Viem, thanks to the support from the professional agency of the trade union, she has consolidated the dossier, gradually completed legal procedures and sued Sang Production - Import-Export - Trading Co., Ltd. in the People's Court of Region 2 - Ho Chi Minh City.

After a period of being accompanied by the Trade Union, the Court ruled that I won the lawsuit, forcing the company to pay 13 months of social insurance and complete procedures to close the book. I am very happy and hope that functional agencies will soon implement measures to ensure my rights" - Ms. Viem shared.

Similarly, the Binh Duong Trade Union Legal Consulting Center also supported Ms. Ngo Thi Huyen Giao (57 years old, from An Giang) to sue and win the lawsuit against the above enterprise.

Thanks to the support center, we have completed the dossier to file a lawsuit in court. We hope the Center will continue to accompany and protect the rights of workers" - Ms. Giao expressed.

Talking to a reporter of Lao Dong Newspaper, Mr. Nguyen Van Dung - Deputy Director of Binh Duong Trade Union Legal Consulting Center - said: "The judgments of the two cases above have now been transferred to the judgment enforcement phase. The Center is continuing to carry out legal procedures to request judgment enforcement, protecting the legitimate rights and interests of workers.

Accompanying workers in difficult times

In October 2024, Hoang Sinh Import-Export Joint Stock Company (abbreviated as Hoang Sinh Company, Binh Duong ward) stopped production activities, but still owed wages to nearly 900 workers. For many consecutive months without wages, workers fell into difficult circumstances. Mr. Vo Hoang Ut Anh (54 years old, from An Giang) is one of the workers who fell into poverty due to prolonged wage arrears from businesses.

Thanks to that support, I was able to pay rent and survive the difficult period. Not only that, the Trade Union also spoke out and carried out legal procedures to protect our social insurance benefits. Currently, the company still owes me social insurance contributions, but the social insurance agency has closed my insurance book. Since then, I have found a new job and continued to participate in insurance" - Mr. Vo Hoang Ut Anh shared.

Similarly, Mr. Nguyen Van Minh (born in 1965, from Vinh Long province, currently temporarily residing in Binh Duong ward, Ho Chi Minh City) was owed 4 months' salary by the company and owed social insurance contributions for more than 1 year.

Being owed wages and social insurance by businesses for a long time, workers do not know what measures to take to protect their rights. I went to the Binh Duong Trade Union Legal Consulting Center to ask officials there for legal advice and to carry out procedures to sue Hoang Sinh Company in court.

Up to now, the court has tried and issued a judgment forcing the business to pay salaries and pay social insurance. Although the benefits have not been claimed, I am happy to have the Trade Union accompanying and supporting me in difficult times. Now I have closed my insurance book and gone to work at another business to continue participating in insurance" - Mr. Minh shared.
