Some workers have not been paid their salaries
Vinh Thong Company owes December 2024 and January 2025 salaries with an amount of more than 5 billion VND and late payment of social insurance as of February 2025 is about 14.6 billion VND. Vinh Thong Company workers have repeatedly stopped working collectively to demand salary and social insurance debt, but the company has not implemented it. After that, 137 workers of Vinh Thong Company authorized trade union officials of the Ho Chi Minh City Labor Federation to sue the company to demand nearly 3.1 billion VND in salary and pay social insurance with an amount of nearly 4.8 billion VND.
According to the decisions recognizing the agreement of the parties and the judgment of the District 9 Court, Ho Chi Minh City, Vinh Thong Company must pay outstanding salaries to workers in 3 installments, no later than November 30, 2025, and by February 28, it must fully pay social insurance for employees.
However, Vinh Thong Company did not strictly implement the decisions and judgments of the Court. In fact, by February 28, this enterprise had repeatedly paid salaries not in accordance with the agreement and had not yet paid all the remaining salaries to some workers. Mr. Le Van Thuan said that according to the decision recognizing the agreement of the parties of the District 9 Court, Ho Chi Minh City, by November 30, 2025 at the latest, Vinh Thong Company must pay the full amount of salary owed to him, but in fact, by February 28, the company had not yet paid it all.
Mr. Pham Van Hien - Deputy Director of the Legal Consulting Center of the Ho Chi Minh City Labor Federation - added that not only Mr. Thuan but also some other workers have not been fully paid their outstanding salaries.
Not being able to pay social insurance, workers suffer losses when giving birth
Not only has Vinh Thong Company not paid all salaries, but it has also not paid social insurance for employees according to the decisions and judgments of the Court.
Ms. Duong Thi Mong Ngoc - formerly the chain manager of Vinh Thong Company - said that she was owed more than 11.7 million VND in salary by the company and has been fully paid. However, the company has not yet implemented the court's judgment on the late payment of social insurance for her from June 2024 to July 2025. Because she was not paid social insurance, in December 2024, when she gave birth, she suffered many losses.
I had to have a cesarean section, the hospital fee cost more than 13 million VND. Because the company does not pay social insurance and health insurance, I have to pay for the entire amount myself. The company said that bringing the hospital fee invoice back will pay me 70% - 80% of that amount, but when I submitted the application, the company still did not pay" - Ms. Ngoc angrily recounted.
Not only that, because Vinh Thong Company does not pay social insurance, she also does not receive maternity benefits, leading to a very difficult life. Ms. Ngoc added that due to extremely difficult circumstances, she had to send her child from when he was only 6 months old (now 14 months old) to her paternal grandparents in the countryside to take care of, while the couple continued to go to Ho Chi Minh City to rent a house and work seasonally. Each month, her salary, including overtime, is only more than 8 million VND to cover living expenses.
Similarly, Mr. Thuan also said that Vinh Thong Company has not paid social insurance for him for 2 years and 8 months.
Mr. Pham Van Hien added that, according to information obtained by the Legal Consulting Center of the Ho Chi Minh City Labor Federation, Vinh Thong Company has not paid social insurance for 137 employees with an amount of nearly 4.8 billion VND according to decisions and judgments of the Court. In addition, this enterprise is also late in paying social insurance for many other workers who are still working at the company. "We will continue to request judgment enforcement to ensure the legitimate rights of employees" - Mr. Hien said.
