On September 19, Dak Lak Provincial Social Insurance (BHXH) informed that the provincial BHXH agency is continuing to implement many solutions to protect the rights of workers at enterprises that are late in paying and evading social insurance.
According to research, many union members and workers in the province are wondering about cases where they have quit their jobs, transferred jobs, had labor accidents or are eligible for retirement but businesses still owe social insurance.
This causes employees not to have their contribution period fully confirmed, leading to slow settlement of benefits and affecting legitimate rights.
Regarding this issue, Dak Lak Provincial Social Insurance said that the 2024 Law on Social Insurance has supplemented many mechanisms to directly protect the legitimate rights and interests of employees at enterprises that violate social insurance contribution obligations.
According to Clause 8, Article 13 of the 2024 Law on Social Insurance, employers are responsible for compensating employees according to the provisions of law if they do not fulfill or do not fully fulfill their obligation to pay compulsory social insurance.
This must be done in cases where the violation causes damage to the legitimate rights and interests of employees.
The above regulation creates an additional legal basis to protect employees when businesses do not fully fulfill their social insurance obligations. At the same time, this is also a mechanism to increase the responsibility of employers in complying with the law.
Mr. Ta Duc Hau - Deputy Director of Dak Lak Provincial Social Insurance said that implementing Resolution No. 205/2025/QH15 dated June 24, 2025 of the National Assembly, the Provincial Social Insurance and the Provincial People's Procuracy have signed a Coordination Regulation.
The coordination content includes receiving and processing information, verifying, collecting evidence and initiating civil and public interest lawsuits. Through this, agencies aim to improve the efficiency of recovering late payments and evasion of social insurance and health insurance (BHYT).
This mechanism also contributes to protecting the legitimate rights and interests of workers. At the same time, debt recovery helps ensure the safety of social insurance and health insurance funds.
According to Mr. Hau, the Provincial Social Insurance also proactively coordinates with the Police force to monitor and handle cases of late payment and evasion of social insurance. For businesses showing signs of intentionally evading payment, the Social Insurance agency can transfer dossiers and propose prosecution under Article 216 of the Penal Code.
In addition to handling violations, the Provincial Social Insurance strengthens urging businesses to fulfill their social insurance contribution obligations. Functional agencies monitor the financial situation and late payment times of each unit. Thereby, identifying the causes and taking appropriate handling measures.
