Recovering more than 442 billion VND of late social insurance contributions from the implementation of the National Assembly's Resolution

From coordinating the implementation of Resolution No. 205/2025/QH15 of the National Assembly, Ho Chi Minh City Social Insurance has recovered 442.16 billion VND of late social insurance contributions.

On September 16, Ho Chi Minh City Social Insurance said that, implementing Resolution No. 205/2025/QH15 of the National Assembly on piloting the People's Procuracy (VKSND) to initiate civil cases to protect the civil rights of vulnerable groups or protect public interests and the Regulation on coordination between social insurance agencies and VKSND within the scope of functions and tasks of each sector, Ho Chi Minh City Social Insurance has strengthened exchange and provision of information and documents related to the implementation of social insurance, health insurance, and unemployment insurance policies at labor-using units.

According to Ho Chi Minh City Social Insurance, as of August 31, 2026, the amount of late payment of social insurance, health insurance, and unemployment insurance of enterprises and units is estimated at about 6,600 billion VND, accounting for 4.12% of the revenue plan. Units with amounts and times of late payment affecting the rights of employees are included in the working coordination area. At the working sessions, the two agencies focused on propaganda and explanation of the responsibility of employers, and at the same time requested units to develop plans and urgently remedy late payment amounts according to regulations.

By September 3, 2026, Ho Chi Minh City Social Insurance had coordinated to invite 6,755 units that were late in paying social insurance to work, with a total late payment amount of about 2,161.7 billion VND. As a result, 1,818 units attended the working session, 4,937 units did not come to work but partially overcame the consequences. As a result, the late payment amount of more than 442.16 billion VND was recovered, equivalent to 20.45% of the late payment amount.

Ho Chi Minh City Social Insurance affirms that the fact that units and businesses did not attend the working session according to the invitation does not change the responsibility of employers in fully fulfilling their obligations to pay social insurance, health insurance, unemployment insurance and ensuring the rights of employees. The Social Insurance Agency will conduct inspections and sanctions according to Decree 283/2026/ND-CP and continue to coordinate with regional People's Procuracies to implement the next steps, in accordance with legal regulations.

For cases with signs of crime, related files will be transferred to competent authorities for consideration and handling according to regulations and guidance in Official Dispatch No. 5659/BCA-CSKT dated December 15, 2025 of the Ministry of Public Security on proposing prosecution of violations specified in Articles 214, 215 and 216 of the Penal Code in the field of social insurance, health insurance, and unemployment insurance," Ho Chi Minh City Social Insurance affirmed.

Ho Chi Minh City Social Insurance requests labor-using units that are late in paying social insurance, health insurance, and unemployment insurance to urgently fully fulfill their contribution obligations, rectify the late payment amount, and not prolong it, affecting the social security rights of employees.

Ho Chi Minh City Social Insurance will continue to publicize and update the list on mass media and industry media channels, contributing to ensuring transparency and creating conditions for employees and related agencies to monitor and supervise.
