The number and title of non-specialized workers in villages and residential groups proposed according to the Draft Decree regulating the organization and operation of villages and residential groups is a question from Ms. Nguyen Lan (Ninh Binh).
The Lao Dong Legal Consulting Office replied: The Ministry of Home Affairs has updated the Draft Decree Regulating the organization and operation of villages and residential groups; policies for non-specialized workers in villages and residential groups to continue to collect public opinions.
Accordingly, the draft Decree proposes that non-specialized personnel in villages and residential groups include the titles: Village head or residential group head; Party cell secretary; Head of the Fatherland Front Work Committee.
The number of non-specialized personnel in each village and residential group does not exceed 3 people.
Currently, Decree 33/2023/ND-CP stipulates the number of non-specialized workers in villages and residential groups as follows:
Non-specialized personnel in villages and residential groups with no more than 3 titles (including Party Secretary, Village Head or Residential Group Head, Head of the Fatherland Front Work Committee) are entitled to monthly allowances. In case the Law has other regulations, it shall be implemented according to the provisions of that law.
Encourage concurrently holding the title of Secretary of the Party Cell while also being Village Head, Neighborhood Group Leader or Head of the Village and Neighborhood Group Fatherland Front Committee.
People directly participating in activities in villages and residential groups other than the 3 titles specified in Clause 6, Article 33 of Decree 33/2023/ND-CP are entitled to monthly support.
Non-specialized personnel at the commune level, in villages, and residential groups are allowed to concurrently hold other non-specialized personnel at the commune level, in villages, and residential groups; non-specialized personnel in villages and residential groups are allowed to concurrently hold positions of people directly participating in activities in villages and residential groups.
The draft Decree also stipulates the regime of training, fostering, social insurance, and health insurance for non-specialized workers in villages and residential groups:
People working in villages and residential groups are trained and fostered in knowledge suitable to the task requirements they are currently undertaking (prioritizing training in information technology application skills, digital transformation...); when sent for training and fostering, they are entitled to benefits according to the provisions of law.
Non-specialized workers in villages and residential groups implement compulsory social insurance and health insurance according to the provisions of current law on social insurance and health insurance.
