Non-specialized commune-level officials who have enjoyed benefits under Decree 154/2025/ND-CP can still register to participate in civil servant recruitment exams according to regulations.

The Ministry of Home Affairs has just sent an official dispatch to the Department of Home Affairs of Lam Dong province guiding the handling of some difficulties and obstacles in the process of implementing the Government's decrees, including contents related to Decree No. 170/2025/ND-CP on recruitment, use and management of civil servants.

Regarding the case of non-specialized personnel at the commune level, the Ministry of Home Affairs said that those who have been settled for regimes and policies according to Decree No. 154/2025/ND-CP are not eligible to be recruited as civil servants in the form of recruitment.

However, if non-specialized workers at the commune level who have enjoyed policies according to Decree No. 154/2025/ND-CP have a need to become civil servants, they are still allowed to register for recruitment in the form of civil service exams according to regulations. The Ministry of Home Affairs requests the Department of Home Affairs of Lam Dong province to guide these cases to register to participate in the exam.

On the other hand, the Ministry of Home Affairs also cited Clause 6, Article 3 of Decree No. 154/2025/ND-CP stipulating: people subject to payroll streamlining, if they are elected or re-recruited into agencies, organizations, and units receiving salaries from the state budget or are arranged to work as non-specialized personnel in villages and residential groups within 60 months from the date of payroll streamlining, they must return the received allowance to the agency or unit that previously paid it.

For the group of leaders and managers of state-owned enterprises, the Ministry of Home Affairs cited point b, clause 3, Article 13 of Decree No. 170/2025/ND-CP.

According to this regulation, people holding leadership and management positions from the department level upwards in enterprises where the State holds 100% of charter capital or enterprises where the State holds over 50% of charter capital or the total number of voting shares may be considered for recruitment as civil servants if they meet the conditions according to regulations.

These cases must have at least 5 years of working experience in accordance with the law; have compulsory social insurance contributions. In case the working time is not continuous and has not received social insurance once, the working time can be accumulated, including the previous working time in positions specified in Decree No. 170/2025/ND-CP.

In addition, the person considered for recruitment must be doing a job with professional and nghiệp vụ requirements suitable to the expected job position to be recruited as a civil servant.
