Decree No. 318/2025/ND-CP details a number of articles of the 2025 Employment Law related to labor registration and the labor market information system.
In which, regulations on adjusting labor registration information are based on Article 7.
Article 7. Adjusting labor registration information
1. Adjust labor registration information in case one or more of the following information changes:
a) Information on the position, job title, profession, type of contract, and workplace specified in Point a, Clause 3, Article 4 of this Decree;
b) Information on employers as prescribed in Point b, Clause 3, Article 4 of this Decree;
c) Information on changes in status from employed people to unemployed people;
d) Change from being employed or unemployed to not participating in economic activities (inability or no need to work).
2. The dossier, order, and procedures for adjusting labor registration information specified in Point a, b, Clause 1 of this Article shall be as follows:
a) In case the employee participating in compulsory social insurance has changed his/her registration information as prescribed in Point a, Clause 1 of this Article, the information on labor registration shall be adjusted when adjusting the information on social insurance registration as prescribed in Article 5 of this Decree;
b) In case the employee is employed and is not subject to compulsory social insurance, the employee is unemployed, it shall comply with the provisions of Article 6 of this Decree.
3. The dossier, order, and procedures for adjusting labor registration information specified in Point c, Clause 1 of this Article shall comply with the provisions of Article 6 of this Decree.
4. The dossier, order, and procedures for adjusting information specified in Point d, Clause 1 of this Article shall be implemented as follows:
a) Employees access the National Employment Exchange (https://www.vieclam.gov.vn) or on the VNeID electronic identification application, select the registration section, adjust the labor registration information and make adjustments from being employed or unemployed to not participating in economic activities according to the content of the Electronic Declaration in Clause 1, Article 6 of this Decree;
b) The labor registration system receives, processes and returns the adjustment results immediately after the employee completes the Electronic Declaration, if the registration is unsuccessful, the system will respond to the reason;
c) Adjusted information of employees is updated and synchronized in the employees database.
5. In case the employee signs a labor contract with many employers who need to update and supplement, the implementation is as follows:
a) The dossier for updating labor information is an electronic declaration according to the form issued with this Decree and documents proving the occupation and workplace;
b) Forms of registration, procedures for implementation according to the provisions of Clause 2 and Clause 3, Article 6 of this Decree.
