The Government has just issued Decree No. 318/2025/ND-CP detailing a number of articles of the 2025 Employment Law related to labor registration and the labor market information system.
In which, the regulation on subjects of labor registration is based on Article 3.
Article 3. Subjects of labor registration
1. Employees subject to compulsory social insurance as prescribed in Clause 1, Article 2 of the Law on Social Insurance No. 41/2024/QH15.
2. Employees who are employed and are not subject to compulsory social insurance.
3. Unemployed people are unemployed, looking for a job and willing to work.
4. Cadres, civil servants, public employees, and the People's Armed Forces shall not register or adjust labor registration information according to the provisions of this Decree.
5. Employees self-declare labor registration documents and are responsible before the law for the honesty and accuracy of the declared information; employers are responsible for collecting, declaring and providing complete, accurate and timely information about employees when recruiting, changing or terminating labor relations according to the provisions of this Decree; ensuring the accuracy and accuracy of the provided information.
The dossier, order, and procedures for registering workers for employees subject to compulsory social insurance are based on Article 5.
Article 5. Documents, order, and procedures for labor registration for employees subject to compulsory social insurance
1. The labor registration file is the Declaration of registration for social insurance participation as prescribed in Clause 1, Article 27 of Law No. 41/2024/QH15, in which the information specified in Point a, b, Clause 3, Article 4 of this Decree is supplemented.
Vietnam Social Security is responsible for issuing a Declaration of Registration for social insurance.
2. Implementation procedures:
a) Employees provide employers with relevant information in the Declaration as prescribed in Clause 1 of this Article and are responsible for the accuracy of the information;
b) Employers register and adjust labor registration information for employees when submitting registration documents, adjust information on social insurance participation according to the provisions of the Law on Social Insurance and guiding documents;
c) Information on employee labor registration after being received and processed by the social insurance agency is processed synchronously and shared with the employee database.
