Youme Law Firm LLC said that, based on Point a, Clause 1, Article 17 of the Regulations issued with Decision 398/QD-TTCP in 2021 issued by the Government Inspectorate, it is stipulated as follows:
Accepted as a civil servant
1. Based on the conditions for registering for civil servant recruitment and according to the requirements of the job position to be recruited, the head of the public service unit is considered for admission to civil service in the following cases:
a) Cases with at least 5 years of working in a job position requiring university education level or higher in accordance with the requirements of the job position to be recruited and having paid compulsory social insurance (excluding internship and probationary periods, if there is a working period with non-continuous compulsory social insurance contributions but have not received a one-time social insurance subsidy, it will be accumulated, including the working period if there was a previous job position in the subjects specified in this Clause), including:
People who are commune-level cadres and civil servants;
People who are signing labor contracts to do professional and technical work in public service units or non-public service units as prescribed by law;
Salary earners in the People's Armed Forces, people working in key organizations;
People working in enterprises with 100% state capital, enterprises with over 50% state capital or total voting shares;
People working in professional political and social organizations, social organizations, and social and professional organizations.
b) People who have been cadres, civil servants, and public employees, and then have been approved by competent authorities to work in armed forces, cryptography, socio-political organizations - professions, social organizations - professions, enterprises with 100% state capital or enterprises with over 50% state capital or total voting shares.

Accordingly, people who are commune-level cadres to be accepted as civil servants at the Government Inspectorate must meet the following conditions: Having worked for at least 5 years in a job position requiring university training level or higher, in accordance with the requirements of the job position to be recruited, and having paid compulsory social insurance.
