Clause 1, Article 13 of Decree 115/2020/ND-CP amended by Clause 7, Article 1 of Decree 85/2023/ND-CP stipulates as follows:
Accept as a civil servant
1. Based on the conditions for registration for civil servant recruitment and according to the requirements of the job position to be recruited, the head of the competent recruitment agency decides to accept civil servants in cases that meet the standards and conditions of the job position, specifically as follows:
a) People with 5 years or more of service working in a professional or technical job suitable for the job position expected to be received at an agency, organization or unit established in accordance with the provisions of law.
The working time specified in this point is the working time in professional expertise and skills suitable for the job position expected to be received in accordance with the provisions of law, with compulsory social insurance payment, not including internship time as prescribed in Article 21 of this Decree.
In case the probationary and probationary period at the job being held according to the provisions of law is less than the probationary period of the job being accepted as prescribed in Clause 2, Article 21 of this Decree, this smaller difference will be counted as probationary period.
In case of non-continuous working time but have not received a one-time social insurance subsidy, it will be accumulated.
b) Commune-level cadres and civil servants who are doing work in accordance with the job position expected to be received.
c) People who have been a cadre, civil servant, or public employee, and are then decided by competent authorities in writing to transfer to work at other agencies, organizations, or units but still do work in accordance with the expected job position.

Thus, commune-level civil servants who are doing work in accordance with the job position expected to be received are eligible to be accepted as civil servants.
