Based on Clause 8, Article 76 of the 2023 Housing Law, there are regulations for cadres, civil servants, and public employees according to the provisions of law on cadres, civil servants, and public employees who are eligible for social housing support policies.
According to Article 29 of Decree 100/2024/ND-CP (amended and supplemented in Decree 54/2026/ND-CP) stipulating housing conditions as follows:
- In case there is no housing owned by them, it is determined when the subject specified in Clause 1, Article 77 of the 2023 Housing Law and the spouse of that subject (if any) are determined to have no name or no housing information content in the Certificate of land use rights, ownership of assets attached to land in the province or centrally-run city where the social housing project is located.
- In case the subject specified in Clause 1, Article 77 of the 2023 Housing Law owns a house but the average housing area per capita is less than 15 m2 of floor space/person. The average housing area per capita specified in this clause is determined on the basis of including: the applicant, the spouse of that person, the father, mother (if any) and children of that person (if any) registered permanently residing in that house.
In addition, Clause 2, Article 9 of Resolution 201/2025/QH15 piloting a number of specific mechanisms and policies for social housing development (effective from June 1, 2025) stipulates:
2. In case the subject entitled to social housing support policies according to the provisions of the law on housing has a workplace far from their residence, the housing condition for being able to buy or rent-purchase social housing is that they have not been able to buy or rent-purchase social housing, do not have housing owned by them, or have housing owned by them but far from their workplace. Based on the actual conditions of the locality, the Provincial People's Committee shall specify the cases where they have housing owned by them but far from their workplace are entitled to social housing support policies.
Based on Article 30 of Decree 100/2024/ND-CP amended and supplemented in Decree 54/2026/ND-CP and Decree 261/2025/ND-CP stipulating, for subjects specified in Clauses 5, 6 and 8, Article 76 of the 2023 Housing Law, the following income conditions must be ensured:
(i) In case the applicant is a non-married person or is certified as single, the average monthly actual income does not exceed 20 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
In case the applicant is a non-married person or is certified as single and is raising a minor child, the average monthly actual income does not exceed 30 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
(ii) In case the applicant is married according to the provisions of law, the applicant and their spouse have a total average monthly actual income of no more than 40 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
(iii) The time to determine income conditions as prescribed in points (i), points (ii) is within 12 consecutive months, calculated from the time the competent authority performs the confirmation.
