According to Youme Law Firm, Article 2 of Decree 178/2024/ND-CP is amended by Clause 2, Article 1 of Decree 67/2025/ND-CP as follows:
- Cadres, civil servants, public employees, and people working under labor contracts in agencies, organizations, and units specified in Article 1 of Decree 67/2025/ND-CP and armed forces are directly affected by the implementation of organizational restructuring and administrative unit restructuring at all levels (hereinafter referred to as organizational restructuring).
- civil servants and employees receiving salaries from the State budget according to the provisions of law before January 15, 2019 and armed forces with at least 5 years left until retirement age in agencies, organizations and units specified in Article 1 of Decree 178/2024/ND-CP are not directly affected by the arrangement of the apparatus but must streamline the payroll, restructure and improve the quality of cadres, civil servants and public employees.
- People working within the staffing quota and receiving salaries from the State budget at associations assigned by the Party and the State at the central, provincial and district levels are directly affected by the implementation of organizational arrangement, consolidation and consolidation.
- Cadres who are not old enough to be re-elected or reappointed as prescribed in Clause 1, Clause 2 and Clause 3, Article 2 of Decree 177/2024/ND-CP dated December 31, 2024 of the Government regulating the regime and policies for cases of non-re-election or reappointment; cadres who are eligible for re-election or reappointment to the Party Committee at the same level, have a working period from the date of congress) from 2.5 years (30 months) to 5 years (60 months) to the retirement age prescribed in Clause 4, Article 2 of Decree 177/2024/ND-CP and cadres participating in Party committees at Party committees must complete their activities, perfect the apparatus with 5 years (60 months) or less until retirement, and wish to retire early to create conditions for personnel at the Party Committee level in the 14th National Party Congress to be submitted to the 14th National Party Congress and have the full consensus of the Party Congress.
However, policies for cadres whose working time has been extended will remain the same.
Specifically, Article 8 of Decree 178/2024/ND-CP stipulates that cadres who are past the prescribed retirement age but have been decided by the Politburo and the Secretariat to extend their working time in agencies of the Party, State and socio-political organizations, if they retire, will receive a one-time pension subsidy equal to 30 months of current salary and social insurance benefits according to the provisions of the law on social insurance.
