On March 30, according to the Government's Electronic Information Portal, the Ministry of National Defense is organizing a consultation on the second draft of the Circular on policies and regimes when reorganizing and streamlining the apparatus in the Army to continue editing and perfecting documents.
In particular, Article 8 of the draft Circular proposes conditions and ways to calculate policies for cases that are not old enough to be re-elected or reappointed; meet the age requirement for re-election or reappointment or are participating in Party committees at all levels of the Party Committee that must end their activities but wish to retire early.
The expected subjects of application and conditions for enjoying policies and regimes include:
- Officers, professional soldiers, defense officials, and people working in key positions under the Government Support Committee receive salaries as for soldiers specified in Clause 1 and Clause 4, Article 2 of this Circular holding positions and titles under the structure of participating in Party committees, full-time members of the inspection committee at the same level but not meeting the age requirements for re-election or reappointment to the new term.
- Subjects at Point a of this Clause who meet the age requirement for re-election or reappointment to the new term of office for the Party Committee have a working time from 30 months to 60 months from the date of the congress; in special cases where there is still 12 months to less than 30 months, the highest service age limit will expire or reach the retirement age according to the instructions in Clause 5, Article 5 of this Circular, but because of the arrangement of personnel at the Party Committee level, they wish to retire and are approved by the competent authority.
- Subjects specified in Clauses 1, 2, 4 and 5, Article 2 of this Circular who are participating in Party committees in Party committees (5-year term) must end their activities, perfect the apparatus with 5 years (60 months) or less before reaching the highest service age or reach the retirement age according to the instructions in Point a, Point b, Clause 5, Article 5 of this Circular, and wish to retire early, to facilitate the arrangement of Party committee personnel in the Party congresses at all levels towards the 14th National Congress of the Party and be approved by competent authorities.
Subjects eligible for early retirement are entitled to the regimes prescribed in Clause 8, Article 1 of Decree No. 67/2025/ND-CP.
These regimes include:
- The subsidy regime for the number of years of early retirement and the subsidy regime according to the working period with compulsory social insurance contributions shall be implemented according to the instructions in Point b, Point c, Clause 1 and Clause 3, Article 6 of this Circular.
- One-time pension for the number of months of early retirement. Including the pension level upon retirement within the first 12 months from the effective date of the decision to reorganize the apparatus of the competent authority; and retirement from the 13th month onwards from the effective date of the decision to reorganize the apparatus of the competent authority.
