The Government has just issued Decree 374/2025/ND-CP detailing a number of articles of the Employment Law on unemployment insurance (effective from January 1, 2026).
According to Article 6 of this decree stipulating the responsibility for paying unemployment insurance, when terminating labor contracts, employment contracts or terminating employment, employers must pay enough unemployment insurance according to regulations for employees to promptly resolve the unemployment insurance regime for employees.
In case the employer does not pay enough unemployment insurance for the employee, the employee has the right to sue the employer in a competent court within 03 months from the date of termination of the labor contract or work contract to request settlement of benefits related to unemployment insurance in accordance with the law.
The subjects of application according to the provisions of Decree 374/2025/ND-CP are employees and employers who are subject to compulsory unemployment insurance according to the provisions of Article 31 of the Employment Law.
