Ms. Do Thi Huong (Hanoi) is the owner of an individual business household. Currently, Ms. Huong is participating in voluntary social insurance. However, Ms. Huong is wondering whether from July 1, 2025, she will have to participate in compulsory social insurance under the form of individual business household? If I have to participate in compulsory social insurance, what are the procedures for terminating voluntary social insurance and how do I register to participate in compulsory social insurance for individual business households?

According to the provisions of Point m, Clause 1, Article 2, Law on Social Insurance 2024, effective from July 1, 2025, business owners with business registration are subjects participating in compulsory social insurance according to Government regulations.
Currently, the Government is drafting a Decree regulating a number of articles of the Law on Social Insurance for compulsory social insurance, which specifically stipulates which business owners with business registration are subject to compulsory social insurance. After the Decree is issued, the Social Insurance will provide specific instructions.
According to Clause 2, Article 27, Clause 2, Article 28 of the Law on Social Insurance 2024, business owners who are subject to compulsory social insurance can choose one of the following two ways to participate in compulsory social insurance:
- In case of registration to participate in social insurance through an employer, the application includes: declaration of registration to participate in social insurance with a list of employees participating in social insurance.
- In case the business owner submits the application himself, he/she only needs to submit a declaration to participate in social insurance and submit it to the social insurance agency within 30 days from the date of being a compulsory social insurance participant.
After the Government issued a Decree in detailing a number of articles of the Law on Social Insurance on compulsory social insurance, Vietnam Social Insurance will issue a process of guiding the process of collecting social insurance, health insurance, unemployment insurance and unemployment insurance-BNN; manage social insurance books, health insurance cards.
In case from July 2025 Ms. Huong is a subject participating in compulsory social insurance and wants to stop paying voluntary social insurance to participate in compulsory social insurance, she will complete the procedure to report a reduction (the dossier is TK1-TS declaration) to the social insurance agency or the collection service organization where she is participating in voluntary social insurance.
