YouMe Law Company Limited said that currently Decree 75/2024/ND-CP on adjusting pensions, social insurance allowances and monthly allowances is still applied.
Therefore, Decree 75/2024/ND-CP on increasing pensions by 15% in 2026 continues to be applied.
The pension increase of 15% is stipulated in Article 2 of Decree 75/2024/ND-CP as follows:
Adjusting pension increases by 15% on the monthly pension level of June 2024 for 9 groups of subjects specified in Clause 1, Article 1 of Decree 75/2024/ND-CP, including:
(1) Cadres, civil servants, workers, public employees and laborers (including people who have participated in voluntary social insurance for a period of time, people retiring from the Nghe An farmers' social insurance fund transferred according to Decision 41/2009/QD-TTg; soldiers, people's police and people working in key jobs who are receiving monthly pensions.
(2) Commune, ward, and town officials specified in Decree 33/2023/ND-CP, Decree 92/2009/ND-CP (document expiring from August 1, 2023), Decree 34/2019/ND-CP (document expiring from August 1, 2023), Decree 121/2003/ND-CP (document expiring from January 1, 2010) and Decree 09/1998/ND-CP (document expiring from November 10, 2003).
(3) People who are receiving monthly unemployment benefits according to the provisions of law; people who are receiving monthly benefits according to Decision 91/2000/QD-TTg, Decision 613/QD-TTg in 2008; rubber workers who are receiving monthly benefits according to Decision 206-CP in 1979.
(4) Commune, ward, and town officials who are receiving monthly allowances according to Decision 130-CP in 1975 (document expired from June 1, 1993) and Decision 111-HDBT in 1981.
(5) Military personnel who are receiving monthly allowances according to Decision 142/2008/QD-TTg (amended and supplemented by Decision 38/2010/QD-TTg).
(6) People's Police are receiving monthly allowances according to Decision 53/2010/QD-TTg.
(7) Military personnel, people's police, and people working in key jobs receive salaries as for military personnel and people's police who are receiving monthly allowances according to Decision 62/2011/QD-TTg.
(8) People who are receiving monthly occupational accident and disease allowances.
(9) People who are receiving monthly survivorship benefits before January 1, 1995.
The above-mentioned groups of subjects from (1) to (7) who retire to enjoy pensions before January 1, 1995, after having their pensions adjusted up by 15%, with a benefit level lower than 3,500,000 VND/month, are entitled to adjust pension increases according to 1 of 2 levels as follows:
- Increase by 300,000 VND/person/month for people with a benefit level below 3,200,000 VND/person/month;
- Increase to 3,500,000 VND/person/month for people with a benefit level from 3,200,000 VND/person/month to less than 3,500,000 VND/person/month.
