YouMe Law Company Limited said: Article 4 of Decree 176/2025/ND-CP, the order and procedures for implementing social pension allowances according to the following regulations:
(1) The person requesting social pension allowance has a written request for social pension allowance according to Form No. 01 issued together with Decree 176/2025/ND-CP sent directly or through a postal organization or on a network environment to the Chairman of the People's Committee of communes, wards, special zones directly under the province or city where they reside (hereinafter collectively referred to as commune level);
(2) Within 10 working days from the date of receiving the document requesting social pension benefits, the Chairman of the Commune-level People's Committee shall organize the review, verification and standardization of relevant information of the requester of social pension benefits with the national population database, decide and implement the payment of social pension benefits to the requester in accordance with legal regulations.
The time to enjoy the monthly social pension allowance regime is calculated from the month the Chairman of the Commune-level People's Committee signs the decision;
In case the applicant does not meet the conditions to receive social pension allowance, the Chairman of the commune-level People's Committee shall respond in writing, stating the reason clearly.
Note, for cases where beneficiaries of social pensions change their place of residence and request to receive social pension benefits in a new place of residence (according to Form No. 01 issued together with Decree 176/2025/ND-CP), the Chairman of the People's Committee of the commune where they used to reside decides to stop paying social pensions in the area and has a document attached with the relevant documents of the requester to the Chairman of the People's Committee of the commune where the requester's new place of residence is located.
The Chairman of the People's Committee at the commune level where the new residence is located, based on the relevant documents of the requester, considers and decides to continue the social pension allowance and implement the payment of the social pension allowance from the month of cessation of payment at the old residence.
In case the subject currently receiving social pension benefits dies or is no longer eligible to receive social pension benefits as prescribed in Article 2 of Decree 176/2025/ND-CP, the Chairman of the Commune-level People's Committee decides to terminate the enjoyment of social pension benefits.
The period of termination of social pension benefits is from the following month immediately preceding the month the subject dies or does not meet the conditions to receive social pension benefits.
Therefore, when deciding to terminate the enjoyment of 500,000 VND/month of monthly social pension allowance when it falls into the case that the subject currently enjoying social pension allowance dies or is no longer eligible to enjoy social pension allowance according to the provisions of Article 2 of Decree 176/2025/ND-CP, the Chairman of the People's Committee at the commune level decides to terminate the enjoyment of social pension allowance.
