Deputy Director of YouMe Law Company Limited Vu Thuy Trang said: On May 26, 2026, the Government issued Decree 185/2026/ND-CP Regulating the organization and operation of villages and residential groups and regimes and policies for non-specialized workers in villages and residential groups, specifically in Article 19 of Decree 185/2026/ND-CP, it is stipulated as follows:
- Non-specialized personnel at the commune level who are arranged to return to villages and residential groups from July 1, 2025 to before June 30, 2026 to retire due to the arrangement and reorganization of villages and residential groups are entitled to policies for non-specialized personnel at the commune level due to arrangement according to the Government's regulations on streamlining staff.
- In the period from the date the 2024 Law on Social Insurance takes effect (July 1, 2025) until this Decree takes effect, compulsory social insurance contributions for non-specialized workers in villages and residential groups are implemented according to the provisions of the law on social insurance.
Localities are responsible for proactively reviewing, balancing and allocating funds to implement full and timely contributions or arrears, in order to ensure the rights of this group.
Therefore, in case non-specialized workers at the commune level are arranged to return to villages and residential groups from July 1, 2025 to before June 30, 2026 to retire due to the arrangement and reorganization of villages and residential groups, they are entitled to policies for non-specialized workers at the commune level due to arrangement according to Decree 154/2025/ND-CP of the Government on streamlining staff.
In which 5 staff streamlining policies in this Decree include:
(1) Policy on early retirement (Article 6 of Decree 154/2025/ND-CP).
(2) Policy on switching to working in organizations that do not receive regular salaries from the State budget (Article 7 of Decree 154/2025/ND-CP).
(3) Severance policy (Article 8 of Decree 154/2025/ND-CP).
(4) Policies for non-specialized personnel at the commune level to retire immediately from the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government (Article 9 of Decree 154/2025/ND-CP).
(5) Policies for non-specialized workers in surplus villages and residential groups due to the arrangement of villages and residential groups to quit immediately from the time of the arrangement decision of the competent authority (Article 10 of Decree 154/2025/ND-CP).
In case non-specialized workers at the commune level retire immediately from the time of implementing the 2-level local government model according to the provisions of the Law on Organization of Local Government and are arranged to work as non-specialized workers in villages and residential groups, they are not entitled to the policies specified in Decree 154/2025/ND-CP according to the provisions of Clause 4, Article 9 of Decree Decree 154/2025/ND-CP.
