Policy for non-specialized workers in villages and residential groups to quit their jobs due to arrangement

Non-specialized personnel who resign due to the arrangement and reorganization of villages and residential groups are entitled to regimes and policies according to regulations on streamlining staff.

On May 26, the Government issued Decree No. 185/2026/ND-CP stipulating the organization and operation of villages and residential groups and regimes and policies for non-specialized workers (NHĐKCT) in villages and residential groups.

Article 16 of the Decree stipulates the management, use, training, fostering and regimes and policies for NHĐKCT in villages and residential groups.

NHĐKCT in villages and residential groups is subject to the management, direction, guidance, and assignment of tasks of local Party committees and authorities at commune level and relevant legal regulations.

NHĐKCT in villages and residential groups are trained and fostered in knowledge and skills suitable to the assigned task requirements; prioritize fostering skills in propaganda, mobilizing people, mediation at the grassroots level, organizing community activities; applying information technology, digital transformation, using digital platforms, updating data, exploiting databases and supporting people to access and use online public services according to regulations.

When assigned to participate in training and fostering, they are entitled to benefits according to the provisions of law.

NHĐKCT in villages and residential groups are entitled to compulsory social insurance, health insurance and other regimes and policies according to the provisions of law on social insurance, health insurance and current legal regulations.

NHĐKCT in villages and residential groups resigning due to rearrangement and reorganization of villages and residential groups are entitled to regimes and policies according to the Government's regulations on streamlining staff.

Based on the provisions of this Decree and the actual conditions of the locality, the Provincial People's Committee shall specifically stipulate the standards, tasks and management, use, training, and fostering of NHĐKCT in villages and residential groups and people participating in activities in villages and residential groups.

The transitional clause stipulates that NHĐKCT at the commune level is arranged in villages and residential groups from July 1, 2025 to before June 30, 2026, suspected of being due to the arrangement and reorganization of villages and residential groups to enjoy hill policies with NHĐKCT at the commune level due to arrangement according to the Government's regulations on streamlining staff.

In the period from the date the 2024 Law on Social Insurance takes effect (July 1, 2025) to the effective date of this Decree, compulsory social insurance contributions for NHĐKCT in villages and residential groups are implemented according to the provisions of the law on social insurance.

Localities are responsible for proactively reviewing, balancing and allocating funds to implement full and timely contributions or arrears, in order to ensure the rights of this group.

According to Decree No. 154/2025/ND-CP, PCS in villages and residential groups that have not reached the retirement age as prescribed are entitled to the following regimes:

For people with less than 5 years of service: They are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of service; they are entitled to an allowance equal to 1.5 times the current monthly allowance for each year of service.

For people with 5 years or more of service and under 5 years of retirement age: They are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of early retirement compared to the retirement age; they are entitled to an allowance equal to 1.5 times the current monthly allowance for each year of service.

For people with 5 years or more of service and an age of 5 years or more until retirement age: They are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by 60 months; they are entitled to an allowance equal to 1.5 times the current monthly allowance for each year of service...
