Disabled female worker anxiously waiting for maternity benefits

A female worker at Austgrow Vietnam Group Co., Ltd. (Trang Dai ward, Dong Nai city) was "suspended" from maternity benefits and had to appeal to functional agencies.

Application received from female worker

On July 22, the Department of Home Affairs of Dong Nai City said that it had received a petition from female worker N.T. T (born in 2005, residing in Tan Trieu ward, Dong Nai City) related to labor disputes regarding social insurance.

According to the petition, Ms. N.T. T works as a worker at Austgrow Vietnam Group Co., Ltd. (Trang Dai ward, Dong Nai city). During her working time, every month the company deducts from Ms. T's salary expenses to participate in compulsory social insurance according to regulations. In March 2026, Ms. T took maternity leave. Maternity leave records have been sent, but the company has not yet completed procedures for the social insurance agency to pay maternity benefits for Ms. T.

Believing that the company's failure to pay social insurance caused her not to receive maternity benefits, affecting her legitimate rights, Ms. T sent a petition to the Department of Home Affairs of Dong Nai City to organize labor dispute mediation. She requested the company to pay fully, confirm the social insurance participation process and complete procedures to resolve maternity benefits according to regulations.

Talking to a reporter from Lao Dong Newspaper, Mr. Tran Trung Kien (58 years old, residing in Tan Trieu ward, Dong Nai city), the father-in-law of worker T, said: T has had hearing and speech disabilities since childhood. By 2025, T will marry T.M. C (born in 2000, Mr. Kien's biological child who also has hearing and speech disabilities) and have 1 child. Both husband and wife work as workers at Austgrow Vietnam Group Co., Ltd. and are affected in their rights.

Regarding Ms. T's lack of maternity benefits, the family asked the Trade Union Legal Consulting Center and the Dong Nai City Labor Federation to support in claiming her rights; and at the same time sent a petition for help to functional agencies.

According to the list of units that are late in paying social insurance, health insurance, and unemployment insurance, as of June 30, publicly announced by Dong Nai City Social Insurance, Austgrow Vietnam Group Co., Ltd. has 244 employees, owing 7 months of insurance with a late payment amount of more than 4 billion VND, including: social insurance, health insurance, unemployment insurance, occupational accident insurance.

Workers cannot finalize social insurance books

Mr. Vu Ngoc Ha - a labor law expert in Dong Nai City - said: Businesses that have been slow to pay social insurance in the past have caused great difficulties for workers, causing workers' rights to be "suspended" such as: not being able to retire, not being able to settle sickness and maternity benefits, workers' rights are disadvantaged. When workers work in other companies, their rights are also affected.

Tri An Social Insurance (under Dong Nai City Social Insurance) has coordinated with Trang Dai Ward People's Committee to work with the company to ensure the rights of workers. Representatives of the Dong Nai City Department of Home Affairs said that they have invited relevant parties to conduct mediation on July 23.

According to the Dong Nai City Labor Federation, according to reports from the Dong Nai City Social Insurance, as of May 31, 2026, there are 180 enterprises in the city (with 20 or more employees) that are late in paying social insurance, health insurance, and unemployment insurance for 3 months or more with a total debt (with interest included) of more than 196 billion VND. The situation of evading and owing social insurance, health insurance, unemployment insurance, and occupational accident insurance of employers in the area affects a series of other benefits for compulsory social insurance participants such as maternity allowances, sickness allowances, and labor accident benefits...
