Youme Law Firm LLC said that, based on Article 20 of the 2019 Law on Militia and Self-Defense Forces, the commander of the Commune-level Military Command is a member of the Commune-level People's Committee, reserve officers; in a state of national defense emergency, during war, they are called to serve in the army according to the provisions of the Law on Officers of the Vietnam People's Army 1999 and continue to hold the position of Commander of the Commune-level Military Command.
Regarding the latest command position allowance, based on Article 7 of Decree 72/2020/ND-CP amended by Clause 1, Article 1 of Decree 16/2025/ND-CP, it is stipulated that:
Allowance regime for the position of militia and self-defense commander
1. The allowance for the position of Militia and Self-Defense Commander is paid monthly, the level of benefits is as follows:
a) Commander and Political Commissar of the Commune-level Military Command; Commander, Political Commissar, Military Command of the agency or organization: 561,600 VND;
b) Deputy Commander, Deputy Political Commissar of the Commune-level Military Command; Deputy Commander, Deputy Political Commissar of the Military Command of agencies and organizations; Battalion Commander, Political Commissar of the Battalion; Squadron Commander, Political Commissar of the Squadron; Squadron Commander, Political Commissar of the Permanent Militia Squadron; Company Commander, Political Commissar of the Mobile Militia Company: 514,800 VND;
c) Deputy Battalion Commander, Deputy Battalion Political Commissar; Deputy Squadron Commander, Deputy Squadron Political Commissar; Deputy Squadron Commander, Permanent Deputy Political Commissar of the Militia Squadron; Deputy Squadron Commander, Deputy Political Commissar of the Mobile Militia and Self-Defense Company: 491,400 VND;
d) Company Commander, Company Political Commissar; Squadron Commander, Squadron Political Commissar; Lieutenant of Mobile Militia, Permanent Militia Company Commander: 468,000 VND;
dd) Village team leader: 280,800 VND and receive an additional 100% allowance for the position of platoon leader when concurrently holding the position of platoon leader of the on-site militia, or 100% allowance for the position of platoon leader when concurrently holding the position of platoon leader of the on-site militia. In case the village organizes a militia group on site, it will receive an additional 100% of the position allowance of the squad leader;
e) Deputy Company Commander, Deputy Company Political Commissar; Deputy Squadron Commander, Deputy Squadron Political Commissar: 351,000 VND;
g) Lieutenant Commander; Permanent militia squad leader: 280,800 VND;
h) Squad Leader, Captain, and Squad Leader: 234,000 VND;
2. The period of receiving the position allowance is calculated from the date of the appointment decision and implementation until the date of the decision to cease holding that position; in case of holding the position for 15 days or more in a month, the allowance is for the whole month, holding the position for less than 15 days in a month, the allowance is for 50% of the position allowance of that month.
Accordingly, the Commander of the Commune-level Military Command is entitled to the latest command allowance of VND 561,600.
