New regulations on supporting workers to work abroad when disputes arise

Employees working abroad under contracts when arising disputes with employers will be supported with legal expenses and temporary accommodation.

Deputy Prime Minister Ho Duc Phoc signed Decision No. 34/2025/QD-TTg on the Overseas Employment Support Fund. This decision officially takes effect from September 15, 2025.

Notably, the contents related to supporting Vietnamese workers to work abroad under contracts are noteworthy.

For example, in resolving disputes arising with employees in sending employees to work abroad under contracts, the Decision clearly states that employees will be supported with the cost of hiring lawyers, legal advice, and court fees to resolve cases.

Accordingly, the support level is equal to 50% of the cost of hiring lawyers, legal consultants, court fees but up to 50 million VND/incident; in case the incident involves many employees, the maximum support level is 100 million VND/incident;

Employees, representatives of the labor group (for cases with many employees) or those authorized by the employee or the employee's legal representative shall send a support request letter with a set of support documents in one of the following forms: online, directly, by post or through enterprises, organizations, individuals to the Fund.

The dossier includes: Documents from the competent authority of the host country on receiving complaints from employees legally represented by the representative agency of Vietnam in the host country; copy of the contract to hire a lawyer or legal advice; copy of the employee's passport; authorization document (clearly state the authorization content) or documents proving the legal right to represent according to regulations in case the authorized person or legal representative submits the dossier.

In case the application is submitted through a business, organization or individual, the business, organization or individual must have a written request for support with the employee's application sent to the Fund.

Within 5 working days from the date of receiving a complete dossier as prescribed, the Fund shall check, compare documents and carry out support procedures, at a rate of 25% of the contract value of hiring lawyers and legal consultants, up to 25 million VND/incident, case involving many employees, up to 50 million VND/incident. In case of non-support, a written response must be provided stating the reason.

After the end of the case, the employee or representative of the labor group or authorized person shall send a request for support for the remaining funds with a set of documents proving it in one of the following forms: online, directly, by post or through enterprises, organizations, and individuals to the Fund.

Within 10 working days from the date of receiving the complete documents as prescribed, the Fund shall check, compare documents and carry out procedures to support the remaining costs for employees. In case of non-support, a written response must be provided stating the reason.

In addition to legal support, workers are also guaranteed temporary accommodation when a dispute arises without being arranged a place of residence. Accordingly, the Fund will support 100% of actual costs according to valid invoices and documents. Based on the approved budget, the Fund management agency will submit to the Fund Management Board for support decision.

The above policies not only contribute to protecting the legitimate rights of workers but also demonstrate the State's commitment to accompanying in protecting citizens when working abroad.

Employees are supported according to the provisions of this Decision when they contribute fully to the Fund. The time of application of support is calculated from the time the employee contributes to the Fund.

Employees are supported 01 time for each support content specified in this Decision for 01 time of contribution to the Fund.
