On September 19, the Ministry of Justice's Electronic Information Portal reported that the Ministry of Justice is reviewing the draft decree detailing a number of articles of the Law on Employment on job creation support policies developed by the Ministry of Home Affairs.
The draft devotes a chapter to regulating public employment policies.
Employers who use labor to participate in public service must sign labor contracts with employees and ensure the benefits for employees according to the provisions of labor law, and at the same time implement measures to ensure labor safety and health in accordance with specific labor groups according to the provisions of law.
For programs, projects, and activities implementing public employment policies in the form of contractor selection, which is the participation of the cooperative in implementation according to the provisions of the law on bidding, the wages of employees are paid based on the agreement between employees and the actual working time, volume, and quality of the employee's work.
According to the proposal, for workers who work 8 hours a day and 26 days a month, the salary is calculated monthly and must not be lower than the regional minimum wage.
For employees who do not work enough 8 hours in a day or 26 days in a month, the wages are calculated by hour and must not be lower than the regional minimum wage.
In case workers work overtime, they will be paid wages at 3 levels: On normal days, at least 150%; on weekly days off, at least 200%; and on holidays and Tet, at least 300%.
Regarding working and resting hours, the draft clearly states that workers' working hours do not exceed 8 hours/day. At least 1 day off per week (24 consecutive hours). In special cases where the work cycle cannot be taken off every week, the average monthly leave is at least 4 days.
In case of having to work overtime, the total working hours and overtime hours must not exceed 12 hours in 1 day.
Employees participating in public service in the form of participating in community implementation are entitled to occupational safety and health benefits.
Accordingly, vocational training for occupational safety and health is supported when performing work with strict requirements on occupational safety and health according to the Government's regulations on occupational safety and health technical inspection activities, occupational safety and health training and environmental monitoring of the occupational environment and guiding documents.
At the same time, they are allowed to participate in and enjoy occupational accident insurance in the form of self-defense according to Government regulations.
The investor shall provide information on labor safety and hygiene in accordance with the specific conditions of the locality according to the provisions of the Law on Labor Safety and Hygiene and detailed regulations and instructions for implementation.
The investor shall buy compulsory insurance in construction investment activities and compulsory insurance for other professional liability according to the provisions of law.
