According to Article 2 of Decree 29/2023/ND-CP, which stipulates the subjects of the staff streamlining policy:
Cadres, civil servants, public employees; commune-level cadres, civil servants and people working under indefinite-term labor contracts in administrative agencies are subject to the same regime and policies as civil servants as those prescribed by the Government, if they fall into one of the following cases:
Not meeting the training level according to the professional and technical standards prescribed for the job position being held, but not having another suitable job position to arrange and cannot arrange training to standardize in terms of expertise and profession or being assigned by another agency or individual but voluntarily implementing staff streamlining and being approved by the agency, organization or unit directly managing.
Thus, according to regulations, teachers are civil servants who have not met the training level according to the professional and technical standards prescribed for the job position they are holding, but do not have other suitable job positions to arrange and cannot arrange for retrainment to standardize the expertise and profession;
Or are assigned to work by another agency but individuals voluntarily implement staff reduction and are approved by the agency, organization or unit directly managing them, they are subject to staff reduction according to regulations.
