Sending a question to the Social Insurance agency, reader N.T.T said: "I have been paying social insurance for 6 years and 3 months, due to family circumstances, I resigned and the social insurance agency confirmed the total time I participated in social insurance and unemployment insurance on the social insurance book.
I request competent authorities to guide me on the process of receiving unemployment benefits.
Regarding this issue, Lao Cai Provincial Social Insurance answers as follows:
Clause 3, Article 34, Chapter VIII of Decree No. 374/2025/ND-CP dated December 31, 2025 of the Government detailing a number of articles of the Employment Law on unemployment insurance stipulates the responsibilities of public employment service organizations, which clearly states:
Organize the receipt, consideration and implementation of procedures for resolving dossiers requesting unemployment benefits, supporting training, fostering, and improving professional skills.
In case, during the process of implementing online public services, electronic data on population, social insurance, and unemployment insurance of employees is not consistent with information on legally valid documents such as Citizen Identification Cards, social insurance books or other legal documents, public employment service organizations are responsible for guiding employees to request competent authorities to review, compare, adjust electronic data and submit dossiers directly according to regulations".
Accordingly, to be resolved to receive unemployment benefits, Ms. Thuan is requested to contact the Employment Service Center under the Department of Home Affairs in the locality where she needs to receive unemployment benefits (not depending on the place where she worked before) to be guided, receive and resolve dossiers according to regulations.
The Social Insurance agency shall pay unemployment benefits to employees after receiving the Unemployment Benefit Decision issued by the Department of Home Affairs and transferred to the Social Insurance agency.
