Article 18 of Decree No. 115/2020/ND-CP stipulates the signing of work contracts and job placement for civil servants in public service units as follows:
1. No later than 15 days from the date the successful candidate completes the recruitment documents, the head of the competent agency or unit recruiting the civil servant shall make a recruitment decision and at the same time send the decision to the successful candidate at the registered address and the public service unit using the civil servant to know and sign a work contract with the civil servant.
2. Within 30 days from the date of receipt of the recruitment decision, the person recruited as a civil servant must go to the public service unit using the civil servant to sign a work contract and receive the job, unless the recruitment decision stipulates another term or the competent authority or unit recruiting the civil servant agrees to extend it.
3. In case the person recruited for civil servants does not come to sign a work contract and receive the job within the time limit prescribed in Clause 2 of this Article, the head of the public service unit employing the civil servant shall propose to the competent authority or unit to recruit the civil servant to cancel the recruitment decision.
Clause 4 of Article 18 of this Decree is amended by Clause 11, Article 1 of Decree 85/2023/ND-CP effective from December 7, 2023 as follows:
4.Within 30 days from the expiry of the time limit specified in Clause 2 of this Article, the head of the competent authority recruits publicly on the website or the electronic portal of the competent authority to recruit and send a notice to the recruiters with the lower recruitment results (in order) compared to the recruitment results of the admission person who has been able to abolish the results of the Decree.Make recruitment decisions and sign working contracts.
At the end of the 30 -day period in this Clause, there is still not enough targets according to the 1st wish, consider the 2nd aspiration as prescribed in Clause 3, Article 10 of this Decree.
In case of right after the recruitment period, the new recruitment needs for the job position with requirements on the standards and conditions such as the job position that the candidate has registered, within 12 months from the date of approval of the recruitment plan, the head of the recruitment agency for consideration, deciding the matriculation for the recruiter with the lower recruitment results to the recruitment results until the recruitment results of the recruitment.In case of 2 or more people with lower -equal lower recruitment results, the head of the competent agency recruits the decision of the successful person according to the provisions of Article 10 of this Decree ”.
