Article 11 of Decree 158/2025/ND-CP (effective from July 1, 2025) specifically stipulates the temporary suspension of compulsory social insurance payment as prescribed in Clauses 2 and 3, Article 37 of the Law on Social Insurance
1. Cadres, civil servants and public employees participating in compulsory social insurance who are detained or temporarily suspended from work for 14 working days or more in a month shall have their compulsory social insurance payment suspended as follows:
a) During the period of detention or temporary suspension from work for 14 working days or more in a month, cadres, civil servants, public employees and employers shall temporarily suspend payment of compulsory social insurance;
b) After the detention period, temporarily suspended from work for 14 working days or more in a month, if the cadres, civil servants, and public employees are repaid 100% of their salary during the detention period or temporarily suspended from work, they shall pay compulsory social insurance compensation for the period of detention or temporarily suspended from work. The deadline for compensatory payment is the last day of the month following the month in which the suspension ends. The compensation for the months of suspension is equal to the amount payable for compulsory social insurance as prescribed in Articles 33 and 34 of the Law on Social Insurance.
In case after the compensation payment period at the latest, the employer and the staff, civil servants and public employees pay compensation for the months of temporary use, it shall comply with the provisions of Articles 40 and 41 of the Law on Social Insurance;
c) In case after the detention period, temporarily suspended from work for 14 working days or more in a month, if the cadres, civil servants, and public employees do not receive 100% of their salary during the detention period or temporarily suspended from work, they will not be required to pay compulsory social insurance for the period of detention or temporary suspension from work.
