From July 1, 2025, the procedure for granting work permits to foreigners will be directly implemented by the Chairman of the Provincial People's Committee instead of the Ministry of Labor, War Invalids and Social Affairs as before.
According to Clause 2, Article 8 of Decree 128/2025/ND-CP, the Chairman of the Provincial People's Committee shall implement the following contents:
- Approving the need to use foreign workers;
- Confirmation of not being subject to a labor license;
- Issuing, reissuing, extending and revoking labor licenses.
Clause 4, Article 15 of this Decree also amends the forms in Decree 152/2020/ND-CP in the direction of: Replacing the phrase "Ministry of Labor, Invalids and Social Affairs" with "Chairman of the Provincial People's Committee/Director of the Department of Home Affairs".
Before July 1, 2025, the entire process will be directly implemented by the Ministry and the Department of Employment under the Ministry.
Also according to Decree 128/2025/ND-CP, from July 1, 2025, the authority to grant work permits to foreigners will officially be transferred to the Provincial People's Committee. Along with that, the process and documents for granting new, re-granting, and extending licenses are detailed in Appendix II of the Decree.
Relevant administrative procedures are guided in Section 2 of Appendix II as follows:
- New licensing: The dossier includes a license application (Form 11/PLI), a health certificate, a criminal record, an expert/management documents, photos, documents approving the use of foreign labor... (Clause 3).
- Re-issuance of the license: Applicable in cases of loss, damage, change of information or change of business name (Clause 4)...
Before July 1, 2025, all of these procedures will be carried out through the Department of Employment (Ministry of Labor, Invalids and Social Affairs) and the Department of Labor, Invalids and Social Affairs. Now it is transferred to the Provincial Chairman and the Department of Home Affairs.
