Dong Nai Provincial Police have just signed a decision to administratively sanction and request the revocation of advertising products that are incorrect for Nestle Vietnam Co., Ltd. (address at No. 7, Street 17A, Bien Hoa 2 Industrial Park, An Binh Ward, Bien Hoa City).
Previously, Dong Nai Provincial Police received information with signs of the crime of "deceiving customers", which occurred at Nestle Vietnam Co., Ltd.
The Investigation Police Agency of Dong Nai Province Police and the People's Procuracy of Dong Nai Province agreed to include in the report according to Joint Circular 01/2021/TTLT-BCA-BQP-BTC-BNN and PTNT-VKSNDTC.
During the investigation to verify and determine that the act did not constitute a crime, on June 13, 2025, the Investigation Police Agency of Dong Nai Province Police issued a decision not to prosecute a criminal case due to insufficient elements to constitute the crime of "deceiving customers".
However, the act of posting false and inaccurate information on the packaging of the product "Nestle Milo Barley Milk" and advertising on mass media, causing confusion for consumers.
Behavior 1: Causing confusion for consumers by providing false, incomplete, and inaccurate information about one of the contents specified in Point a, Clause 1, Article 10 of the Law on Consumer Protection, stipulated in Point a, Clause 2, Article 47 of Decree No. 98/2020/ND-CP dated August 26, 2020 of the Government regulating administrative sanctions for commercial activities, production, and trading of counterfeit goods, prohibited goods, and protection of consumer rights;
Behavior 2: Advertising using the words " first", "most", "Best", "number one" or words with similar meanings without legal documents proving it as prescribed, as prescribed in Point a, Clause 2, Article 34 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government regulating administrative sanctions in the field of culture and advertising.
Based on the above acts, on June 13, 2025, the Director of Dong Nai Provincial Police issued a Decision to administratively sanction Nestle Vietnam Co., Ltd. for the above two violations.
At the same time, request Nestle Vietnam Co., Ltd. to immediately take remedial measures, forcing Nestle Vietnam Co., Ltd. to correct false or misleading information; forcing the removal, removal, and erasure of advertisements on means and forms of advertising that Nestle Vietnam Co., Ltd. has advertised for the product "Nestle Milo Barley Milk" with violations of advertising content or recall of advertising newspaper and printed magazine products (if any).
Dong Nai Provincial Police also requested Nestle Vietnam Co., Ltd. to take remedial measures within 10 days from the date of receipt of the decision to sanction the above administrative violation.
