Hanoi City Social Insurance has just issued a notice on the list of employers who are late in paying social insurance, health insurance, unemployment insurance, and occupational accident insurance for 2 months or more in Hanoi City. In the list, it is noteworthy that many businesses have large debts, lasting for many months, even years, that have not been completely resolved.

At the top of the list is still the "familiar" name - Apax English Joint Stock Company, with a social insurance payment delay of up to 74 months and an amount of over 65.2 billion VND. Second is LILAMA3 Joint Stock Company with 131 months of social insurance payment delay, total amount of nearly 49.7 billion VND. Next is Cau 12 Joint Stock Company, social insurance payment delay of 106 months with an amount of nearly 30.1 billion VND...

In addition to enterprises that are late in paying social insurance for over 30 billion VND, the list also records nearly 20 units late in paying from 10 to more than 26 billion VND, such as Xuan Kien VINAXUKI Automobile Joint Stock Company Branch - Automobile Factory No. 1, Me Linh, late in paying social insurance for more than 26.8 billion VND for 166 months; Transport Engineering Joint Stock Company 116 late in paying 180 months, with an amount of more than 21.2 billion VND; CMS International Thinking and Creativity Education Joint Stock Company late in paying social insurance for 63 months, more than 12.5 billion VND...

As of May 22, Mr. Nguyen Van Hoa (Phu Tho) was late for social insurance payment by Lilama 3 Joint Stock Company for nearly 7 years, with an amount of 194 million VND.

Mr. Hoa said that in July 1997, he signed a working contract with Lilama 7 Company in Da Nang, then in June 2006 transferred to Lilama 3 Company (in Phu Tho) - later the company moved to Bac Tu Liem, Hanoi. In February 2022, Mr. Hoa terminated his labor contract with Lilama 3 Company. However, he did not receive his social insurance book.

According to Mr. Hoa, currently in the same situation as him, there are also many colleagues who are late in paying social insurance, so they are struggling to make a living. To claim benefits for himself and his colleagues, he has repeatedly come to LILAMA 3 Joint Stock Company to request leaders to implement regimes for employees who have terminated their contracts; and at the same time sent petitions for help to functional agencies but without results...

“After terminating the contract, I have repeatedly requested the leaders of Lilama 3 Company to finalize and return the social insurance book, but the company's leaders always postpone and promise to pay social insurance money. But up to now, that promise has not been fulfilled by the company's leaders” - Mr. Hoa said.

Some businesses intentionally delay paying social insurance

The fact that more than 23,800 businesses are late in paying social insurance, with an amount of up to over 2,205 billion VND, is posing a major challenge in ensuring social security in Hanoi.

Mr. Vu Duc Thuat - Deputy Director of Hanoi Social Insurance - affirmed: "Not registering for social insurance participation or late payment of social insurance not only directly affects the legitimate rights of employees but is also an act of violating the law. Depending on the severity and nature of the violation, units may be administratively sanctioned, or even considered for criminal handling according to current regulations.

Also according to Mr. Thuat, in the past time, in order to reduce the situation of prolonged social insurance payment delays, Hanoi Social Insurance has synchronously implemented many solutions. The focus is on promoting propaganda and dissemination of policies and laws on social insurance and health insurance. In particular, the Social Insurance agency strengthens direct dialogue with businesses that are late in paying to remove obstacles.

At the same time, the City Social Insurance assigns specific targets to each specialized revenue management officer, including revenue, late payment amounts and participant development. Implementation results are evaluated weekly, as a basis for monthly, quarterly and annual emulation evaluations.

Notably, Hanoi Social Insurance has coordinated with departments and branches to establish an inter-sectoral working group to work with units that are late in payment for more than 3 months. The composition includes: Department of Home Affairs, City Labor Federation, City Inspectorate, Tax Department and City Police. Through implementation, units and businesses have paid over 700 billion VND, contributing to a significant reduction in late payment amounts in the area.

Every month, the social insurance agency analyzes and classifies units that are late in paying according to types, industries and delays to determine the causes, thereby applying appropriate urging measures. Periodically on the 5th and 20th, social insurance sends notices of the provisional amount so that units can proactively pay ahead of schedule...
