When will pension and social insurance allowance be temporarily suspended?
According to Article 75 of the 2024 Law on Social Insurance, the payment of monthly pensions and social insurance allowances may be suspended in three specific cases, including failure to verify personal information, illegal exit and being declared missing by the Court.
Personal information cannot be verified
People receiving pensions or social insurance allowances through personal bank accounts are obliged to periodically verify personal information according to the guidance of the social insurance agency.
If the beneficiary does not implement or verification is unsuccessful, the payment will be temporarily suspended until the confirmation procedures are completed. This regulation aims to prevent acts of impersonation, profiteering from regimes, and at the same time ensure the right to pay to the right people and right subjects.
Illegal exit
People currently enjoying pension benefits who illegally exit the country or reside abroad without declaring to functional agencies will be suspended from paying pensions and allowances.
According to the Social Insurance agency, paying for cases that no longer legally reside in Vietnam is contrary to legal regulations and poses a risk of loss of the social security fund.
Declared missing by the Court
If a pension or social insurance allowance beneficiary is declared missing by the Court, the social insurance agency will temporarily suspend payment because it cannot verify the actual situation.
When there is a decision to cancel the declaration of missing or confirm the survival, the payment will be fully restored.
Notes on conditions for restoring pensions and social insurance allowances
Clause 3, Article 75 of the 2024 Law on Social Insurance stipulates that people who are temporarily suspended from enjoying benefits will be considered for re-payment, including the part of pensions and allowances not received during the interruption period, if they meet the following conditions:
- Illegal exiters return to Vietnam and fully fulfill legal obligations.
- Person whose disappearance decision or declaration of death is revoked by the Court.
- The person who has completed personal information verification according to the regulations of the social insurance agency.
To avoid interrupting benefits, the social insurance agency recommends that people:
- Comply with entry and exit regulations while enjoying pension benefits.
- Perform periodic information verification through bank accounts or channels authorized by social insurance.
- Report promptly when changing address, personal information or residence status.
