In particular, Article 28 of Decree 219/2025/ND-CP clearly stipulates the procedure for extending the labor license as follows:
Article 28. Procedures for renewing labor licenses
1. At least 10 days but not more than 45 days before the expiration of the labor license, the employer shall submit an application for an extension of the labor license directly or through the public postal service or through the service lease of a business or individual or through authorization to the Public Administration Service Center in the locality where the foreign employee is working.
2. The local Public Administration Service Center transfers the dossier according to the provisions of law on implementing administrative procedures according to the one-stop, one-stop mechanism at the one-stop department and the National Public Service Portal to the competent authority to extend the labor license.
3. Within 10 working days from the date of receiving a complete application for a job extension, the competent authority shall consider approving the request and extending the job license for foreign workers.
In case the need to use foreign workers is not approved or the labor license is not renewed, there must be a written response and a clear reason.
4. For foreign workers as prescribed in Points a and m, Clause 1, Article 2 of this Decree, after a foreign worker's work permit is extended, the employer and the foreign worker must sign a written labor contract according to the provisions of Vietnamese labor law before the expected date of continued work for the employer.
When required, the employer must send a signed copy of the labor contract to the competent authority that issued the labor license.
