1. Implementation procedures:
Step 1:
Employees are responsible for submitting the application to the employer. The deadline for submitting documents is no later than 45 days from the date of termination of maternity leave.
Step 2:
Within 7 working days from the date of receiving a complete dossier from the employee, the employer is responsible for making a list of employees on leave to enjoy maternity benefits with the dossier submitted to the social insurance agency.
Step 3
The social insurance agency is responsible for handling the case within 7 working days from the date of receiving complete documents from the employer.
In case of not resolving the issue, a written response must be provided stating the reason.

3. Components and quantity of documents
3.1 Document composition
- List of employees on maternity leave established by the employer;
- Original or copy of discharge paper or summary of medical records or documents proving the inpatient treatment process of employees in case of inpatient treatment;
- Certificate of leave from work to receive social insurance in case of outpatient treatment;
- The original or copy of the discharge paper may include information indicating the time to receive outpatient treatment after the inpatient treatment period.
In case the above documents or documents with similar content are issued by competent foreign agencies, organizations and individuals, the following requirements must be met:
+ Have a notarized or certified Vietnamese translation according to the provisions of the law on notarization and certification;
+ getting consular status legal, except in cases where international treaties to which the Socialist Republic of Vietnam is a member have other provisions.
3.2 Number of documents:

Within 7 working days from the date of receiving complete documents from the employer.

Female workers with extra-uternum pregnancy.
